I was refunded by the MiddleMan, only to be messaged later by recordsmasher asking for the payment which we both agreed clearly would be refunded as shown here: http://gyazo.com/7d904dece71f77f3caffc7c654f08b29

 

From the looks of it, you weren't exactly entitled to a refund.
RecordSmasher would have been required to create a new account for you with the stats you previously had / ordered before the account was banned.

However, it appears you both agreed upon the service being cancelled instead and a refund being given.
What was done may have violated his ToS, but you both made a mutual agreement for the service and it has now been cancelled.
