TOS/Warranty Dispute - AkumaGP

I am creating this thread as @Akumagp and I have discussed our issues and decided it would be best for one of the staff to interpret the TOS and help us reach a decision. I will provide as much neutral evidence as possible and would like Akuma to add anything that I miss that he thinks may be relevant to reaching a decision. Our dispute relates mainly to the verbage in the two screenshots that will be posted below which form a part of the warranty which was given during the transaction. For everyones safety, I have redacted the name of the server, the transaction amount, etc. but we would be happy to provide this to staff under seperate cover privately.

Background: Akuma sold me an RSPS account and at the time of the sale I mentioned that there are a lot of bans for accounts due to RWT so my buyer was only looking for an originally farmed account with no history of the gold being gambled/staked/traded in etc. In essence, my understanding was that the account would have been farmed originally without any infractions or suspicious activities. Akuma subsequently vouhced that the account was a "virgin account" and that the "gold was farmed on this account, no trade, gamble, stake or something to transfer the gold before". He said this was his personal workers account and can vouch for it. These screenshots provide the exact text of what was said:

For greater context, this transaction occured very recently and shortly after the transaction was smoothly executed (within 2-3 days), the account in question was banned and the reasons provided by server staff included RWT which was explicitly defined as the offering to Buy or Sell GP, items or services. This leads me to the interpretation that this was exactly what was warranted and vouched by Akuma and Akuma should provide a replacement and refund. Not to mention that the account at the time had 4x the wealth which was originally provided by Akuma. However, to keep this claim simple, my stance is that the warranty provided explicity stated that the gold was originally farmed and not traded through RWT means. The reasoning provided by server staff contradicts this.

The facts that are not in dispute are the amount of the transaction, the payment provided, the completion of the transaction and the subsequent ban for RWT (Akuma has seen proof of this and is satisfied that the ban did occur). The major dispute relates to the warranty and whether this situation would entitle me to a refund / replacement. Akuma has been responsive and we have stayed in touch and have both agreed to stand by and go with whatever a staff member decides.

@Akumagp - please also add your interpretation and anything else so staff can assist us with determining this.

Hello everyone, we chose to make a report because there is a problem with the TOS.

Being direct, I have sold an account to @Bulk_Buyer and i have vouched any recovery, rwt (trade, gamble, stake, etc.) before selling the account. not after, knowing that they can verify where the account was created and verify its change of location, this could be a reason to get banned.

Also a reason can be simply rwt, 3 days have passed since the transaction, who can assure that your friend did not rwt, nobody, I think not even you.(Usually when i got caught on any rsps, they catch me instantly, they do not wait for 3 - 2 days to ban me, it's instantly as on any rsps, even osrs. )

I'm also a bit worried because @Bulk_Buyer has removed the mods answer and why the account was banned =>

He sent me 2 images with some reasons why the account was banned, it might be friendly if @Bulk_Buyer can send me these 2 images again to show them, because they say some reason is a bit weird to me. one of those reasons was that in their ip, 2 accounts were connected simultaneously and they were practicing pk farming.

I am willing to make a refund if mods decide, I did not do it on my own because heck, it has been 3 days, in what game they wait 3 days to ban a person, if they do not realize it at the time, they will never realize it , speaking based on experience.

The image was only removed as it contains information that can easily identify many things. I am happy to privately send it to any mods that would like to see it and have shown it to Akuma. He is right, the account was accused of many things but I did not mention these as the warranty did not relate to not having PK Famed, evading a ban, using multiple accounts to vote and/or rewards and multi-logging. My stance on this is that it goes to the heart of the account having accumulated the wealth due to illegal means and not organically in accordance with the rules resulting in a ban. The more concerning of all of the reasons provided (as the very first reason) was RWT which goes to the heart of the warranty provided.

Akuma/Mods, let me know if you would like to see the images referencing this and I can share exactly what was shared in full transparency with Akuma.

Btw, rwt is not the first reason, they have rules organized in numbers and they send them to you in their order.
Google it and check.
