Buyacc disputing ban

Ban reason: private report

The ban is unwarranted as Jason did not care about me reposting the image and even thanked me for doing so. I told @Andy Samberg this and all he keeps saying was "the rules are clear" and "Jason cant cherry pick who to report". To dispute both of these reasons.

The rules are clear
To quote the rule:

First of all, nowhere is stated that the explicit consent should be given beforehand. When I brought this up to Andy he ignored it / waved it away. Just to throw back what Andy kept telling me: the rules are clear permission can be given afterwards as well, when looking at the rule.

Second of all, @Wortel and other moderators have said numberous of times that moderators do not act like police. If Jason reported me, I would be fine with the ban. But Jason did not report me and does not care for me particularly reposting it to get Gun banned. It is absurt that I get banned for something that I did not even get reported for by the user who its all about.

You cant cherry pick who to report
This is bullshit. Any owner of something copyrighted has the right to cherry pick who to copyright strike, this is literally the case EVERYWHERE. Why wouldnt Jason be allowed to cherry pick who he allows to post his picture? On top of this, I followed all Jason's instructions when he asked me to remove the reposted picture from Gun. All in all, I did nothing against Jason's will or wishes.

 

Quick input here, BuyAcc didn't have permission to post Jason's photo. As shown here:



And the rule that permission comes beforehand is implied by our rules:

"Posting information such as....without explicit consent of that person will result in up to a 1 month ban"

This says that in order to post someones private details you must have permission. I would argue that statement implies having permission before the fact, not after.

Also regardless of that fact, if users are allowed to cherry pick who gets banned after the fact then they can hold it over others and essentially have the power of moderator banning in their hands. "Do X or else I'll have you banned." "Do X and I'll have you unbanned." Or not even for favors, maybe they just favor their friends like in this instance.

These are the two points I was trying to express to BuyAcc when he pm'd me why he was banned.

EDIT: Also to his point about not policing, Gun contacted me and asked why he specifically would be punished if BuyAcc was not for the same offense? So I didn't bring this issue out of nothing myself, it was brought to my attention. (Also Jason shows that BuyAcc did it too in his evidence he submitted, so it was also as though he was reporting them both.)
