Can i be sued for using and gaining money from sythe?

So yeah, ive had abit problems with police, and some dickhead that was trying to sue me for some sht told police that I gain money via illegal way, they said there will be report to economical police about this. So yeah, ive gained about 2-3k$ from internet via selling rs cash. Can i be sued for this?

 

I highly doubt it, but you should probably talk to a lawyer, just in case.

 

Yeah I wouldn't trust the advice you get here on the subject, I'm sure its possible for you to get sued for that. Talk to a family lawyer or something.

Paypal connected to my card, not bank. Also I had both, paypal and WU payouts.

 

Selling an item that doesn't belong to you, probably can get prosecuted for it, no RS gold isn't yours, it still belongs to Jagex.

Seriously though, I think the only person that can prosecute you for selling RS gold is Jagex, because you're selling their property. I highly doubt the government/police cares enough about virtual goods to look into it, AS LONG as you're declaring it on your taxes and paying them for it.

 

Well, as police investigator told me, that every business that gains you gold have to be taxabled, and has to have license, Myself can gain 100-200$/month without having any problems, if more I have to have licenses, and have registered it as small business or something... Im asking someone that REALLY know and not just says what he thinks.

I doubt alot of people here put their sythe sales on taxes, therefor strictly seen you can get caught but usually not for such low amounts.

You'll be having trouble with moneybookers / paypal if you start doing big amounts and are not recognised as a business company.

You could possibly get into a lot of trouble. The question is how far is the police willing to take this and if they are willing to tell jagex. If jagex finds out, you might get sued by them. Although, i do think the chances of that are low as 2k-3k is not much. Their legal fees would be a lot more.

Your main issue is tax. Depending on what you do in terms of work and what country you live in, you have a tax free threshold. If you earn above that threshold you are liable for paying taxes. if you are self employed (in this particular case you are because your employer, being you, is not filing your tax forms), you need to file your tax forms yourself. Should you not file these forms, you are effectively tax evading which can have significant penalties. Keep the money you received through paypal aside as you might need it. you wont be liable for anything above what youve made in terms of tax.

If you dont work or get paid very little, then you might be fine. Basically, what you earn + this 2-3k you made must be less than your tax threshold. In uk, its £6400 (around this figure), i dont know about where you live. If you have specific questions then pm me, i wont read this again.

You also might get arrested and put in jail for illegal trading depending on your age. Just hope the police officer dealing with you is nice.

EDIT - If i were you, start taking out any threads with your paypal/normal email in. Keep correspondence proof to minimal and try and prove SHOULD something happen, that you made a minimal amount from gold sales.

 

Jagex wouldn't take someone to court just to try get some money, they do it to set an example. Even if they lose $10,000 in court. It's a good deterrent and would lead to more buisness and P/R etc.

 

Tbh it shouldnt be a problem, as long as you haven't scammed the 2-3k$
and have lots of proofs of vouches and stuff
which you could show the police it shouldnt be a problem.

 

if you pay tax on it persay and sell these items with something attached with the "gift" of virtual goods ( and State that they are not being sold for profits because they are jagex's property)

I don't understand how you can be sued by the police for selling Gold from a game for irl money only thing that gets me is maybe the police will Tell jagex which they might take it into there own hands i'm sure the percentages of that happening or slim to nothing if your actually scared contact a lawyer and he could tell you if your in trouble or not.

 

Correct, but technically we're only selling a transfer service, never the actual item.

I don't think so... According to my accountant, since I ran a completely intangible business I'm except from state taxes and the typical business permits. You have to pay federal tax and a solo-business tax, but that's it. The cop probably didn't understand.
