    Came up on the IRC.

Student has Cell Phone. Teacher / principal steals cell phone. Principal charges $15 for Student if he wants it back. If he doesn't pay the fee, they sell it on eBay.

This is quite obviously selling stolen goods. >_>

    Cfrey seems to think otherwise.

    So, pseudo-lawyers, have a feast.

First of all what kind of school does this "student" go to??

Secondly, they have no right to sell it nor ask for money for it? it was rightfuly the students and not there's if anything they should just take it away and g ive it back at the end of school or have your parent get it?? but to have them possibly sell it? that is selling stolen goods no doubt about it??
and Last, they kid needs to go to court if they did sell it..and the kids needs to change schools

But In all Seriousness if a Teacher ever touched my phone, Im going to have to beat his ass.
Sell it back to me for $15? Lmfao.
Yeah, It should be considered stolen goods.
But since electronics are not permitted on school premises, they have the authority to confiscate it.

As I was saying on IRC, if they can claim it disrupts everyone's learning environment then they can do whatever they want. You really don't have rights for 1st and 4th amendments in school.

Just don't give your phone to the teacher if you don't want to pay 15$ for it what are you a pussy. What can they possibly do if you don't give them your phone? Give you a detention or something idk. And it is also wrong to take then hold for ransom a students phone. Like WTF mate.

It depends what type of school. If it's private or public would weigh on the situation heavily. Private schools abide by their own set of rules and before you can gain admittance to the classrooms you usually have to sign to the clauses and rules of that school. I disagree with the return fee, but I don't really see a problem with confiscating someones phone because it does interfere with one's learning abilities.

If the school has a no phone policy then it can do whatever it wants. And I wouldn't call it a ransom more like a punishment fee.

I'm pretty sure you can get suspended for insubordination, and they would still take away your phone. Most schools have a school officer who can take it from you.

yah thats understandable that if they confiscate it and does kinda mess with you learning because you can be in the middle of texting when the teacher could say that ok quiz tommrow!! and then you wouldn't remember and not study!! but even then they shouldn't make you pay 15 dollars for it thats absurd
