First, does anyone know exactly what is legal and illegal when it comes to beer and minors? Is it illegal to merely hold alcohol if you're under 21? Or is it only illegal if the minor consumes it?

That brings me to the main discussion of this thread. It surprises me how many people blatantly post pictures of them holding beers and other drinks on Facebook. It is especially surprising to me when most of them have their privacy settings set to everyone, so anyone could see the pictures. Personally, I don't drink, but if I did, I most definitely wouldn't spam my FB with pictures of me doing so. Would you?

I'm just wondering, could someone actually get in trouble if a police officer saw the pictures, or since most pics only show them holding it (not drinking it), could they not do anything about it?

    Discuss away.

Being in possession of alcohol you must be 21 years of age, or older. The law sees being in possession as using.

They don't do anything about pictures. If you get caught IRL, they get you for possession.

I have many stupid friends on facebook that post their blunts, and show weed on their scales. They can't do anything.

There's so many videos of people smoking cannabis on YouTube as well, they can't do shit.

Actually in the United States you can consume alcohol if your parents allow if your under the age of 21. Also same thing with holding alcohol. This means in your own household you can consume alcohol under the age of 21 i believe and nothing will happen. Posting pictures of you holding alcohol or illegal substance can not subject you to being charged because pictures can be edited now and not taken always as evidence the police would have to get warrant and actually find you with the product on you. Such as pot.

That is true only in some states, in many it is still illegal whether you're drinking with a parent or not. I guess I can see where they could be edited, but honestly, being realistic, no one is going to edit a picture of himself or herself, and then upload it on his or her own FB. But I realize that's exactly what a lawyer would say, which is why they could never prove with only a picture, but meh.

Anyways, I probably somewhat answered my own question, lol.

It depends on the state. Some states allow minors to drink it, just not buy it. Others say you can't touch the stuff.

Which i believe is completely stupid the drinking age in my mind should be 16 like Germany and other countries. Also parents should have the right to allow there kids to drink alcohol

In the UK, the legal drinking age in a private place (e.g. house) is 5, lol. I find it ridiculously funny when I speak to friends from the US, and they mention drinking laws. In public, you have to be 16 to have alcohol with a meal, and it must be purchased by an adult. To purchase alcohol in a store, the legal age is 18, although some stores now require you to be over 21, even though it is not legislation.

But about the pictures, I don't think there is a high chance that the police would act upon some pictures that someone posts on Facebook. It would be too hard to find all their details, and you really cant go arresting every teenager who gets drunk at home and then posts a picture of themselves on facebook.

In the UK it's 5 to drink at home or in private, 16 to drink with a meal (as long as you are supervised by an adult) and 18 to buy it from a shop. The police can't really do anything about it if they see a picture to be honest. I can walk into a museum and handle a rifle while my friend takes a picture but the police can't arrest me for posession of a firearm. In the same way, I might just be holding a bottle of beer to look cool, or for a friend, or I might be putting it in the bin etc. It's largely to do with the circumstances in which you are acting, and obviously a picture can't explain that very well.

Drinking laws are a joke anyway, I'm 15 and I know that I can get any type of alcohol I fancy whenever I want, whether it's through older friends, dodgy shops or shops run by morons.

I've been stopped by the police a couple years ago with a bottle of vodka on me, they didn't do anything.

It's 18 here. Though in other countries the law is even more lax, I've been Brazil many times with friends, and family, I managed to get served there at the age of 13.
