it is really shady. She may say she consents to it at the time, but when she is sober if she chooses that she didnt want it to happen it is still rape. you have to be clean and sober to actually legally consent to sexual activities.

 

I wouldn't personally because of the points NRQ makes. You are screwed if she says its rape and bye bye your life. Well, it could work if you have sex somewhere, obviously not your own place, and then you bail afterwards hoping that she doesnt remember you/your name or anything about you.

 

This is kind of incorrectly named because that isn't really Date Rape...

If a girl is really slutty in the first place she would have sex with you whether she is wasted or not (Unless she's only slutty when drunk ^_^ )

Use a condom and MAKE SURE you ask, whether she remembers or not it is better to not have to lie. If she is totally trashed, you could argue that you were completely trashed as well

But aside from that, Date Rape is when you rape somebody you have taken on an actual date, if you picked her up randomly it's not technically date rape.

That being said, having sex with a drunk chick you DON'T KNOW would be even more risky. I'd just avoid the idea in general.

 

Legal, honestly I don't see how alcohol can turn a girl into a whore like it does. I don't ever do anything I don't want to when I'm drunk... Of course I handle my alcohol. Girls either need to know their limits, or get over it--if they choose to get so drunk they don't know what they are doing and start fucking people, it's their fault. Shouldn't have drank in the first place, and it's pretty fucking horrible if a guy gets a rape charge for having sex with a drunk girl that gives the guy consent to... It's contradictive, and just unfair.

 

I think that if a woman gets raped it's her fault. She shouldn't have put herself in that situation if that was a possibility.

 

A girl has to be in the right state of mind to consent to having sex. Being wasted isn't being in the right state of mind.

 

The thing I hate is the stupid hypocrisy about this. If a guy gets drunk and knocks up someone he otherwise wouldn't have slept with its his fault, but if a girl gets drunk and a guy takes advantage of this (whether he is drunk or not) its also the guys fault. Its best in my opinion not to do random hookups anyways because most of them are pretty shitty at least where I am from anyways.

 

And what no one has mentioned is the situation in which a guy get's drunk and then a girls comes on to him.

Ever woken up to find a girl in your bed that you vaguely remember from the night before? If this happens to a guy, and he's ashamed of what's happened- you don't see him running around saying the girl raped him. But if the situation was reversed, a lot of girls do just that.

So at the risk of sounding like a jerk, that's why it's always best to let the girl give you a BJ before having sex with her. That way if she pulls the whole, "I was too drunk to remember" line, then you can reply with the "you wern't too drunk to play-the-pipe for twenty minutes before hand.

I lived in a fraternity house for a year, so I've heard some pretty screwed up stories that have arisen from just this.

 

If she is a slut then I don't think there should be any sort of "legal" ramifications from sleeping with her. But I don't think I would want to sleep with that kind of nasty hoe anyways...

 

Nothing illegal about it, but from my perspective it's not ethically right. Sex should be given with intelligent consent.

 

Speaking from experience here: alcohol doesn't make girls slutty, it just gives us an excuse.

If I wake up next to the ugliest chick that I never would have fucked sober, then call the cops and try to say it's rape, they'd laugh at me. When girls do it, guys go to prison. Double standards are ridiculous. If you don't want to get raped, don't put yourself in those situations.

 

Honestly, I don't know how people claim that alcohol screws them up so much that they have no idea what they're doing. When I'm drunk, I don't just go sleeping with any girl I see and doing crazy shit. It might lower your standards but you know exactly what you're doing... I agree with Kill Dank there's definitely a double standard involved in these kind of situations.

Of course it should be legal, there's a giant difference between a girl offering a guy, and a guy forcing himself on her. You don't see people getting out of crimes because they were drunk, how should this be any different?

Honestly I'd say it comes down to how intoxicated both individuals are, if the guy is completely sober yet the women is abolsutely wasted, then I would consider that as rape. Or at least describe him as rapey. On the other hand it works both ways as in if a guy is really drunk and unable to control his actions and a sober female takes advantage then she too is rapey, very rapey...
