    I'm sure that the person who purchased your iPhone will reset the phone. It's very common with people who purchase phones off of Craigslist. However, if the person doesn't reset the phone and he/she loses the phone, then I'm sure you will not be involved in any legal problems with your local police. If the phone is, in fact, with AT&T then the person shouldn't have a problem activating it with AT&T. Just remember for future reference to reset your mobile devices when/if you decide to sell via Craigslist.

    I bought it off someone else for a bargain and only used it for WiFi and music.

    @Visual3volution said most people buy their phones whether its an iPhone or Samsung, they always or might perform a factory reset.

    I'm a bit worried being caught on with installous 5 and cydia too.

    But if he knew it wouldn't work he shouldn't have sold it unless he directly stated that it did not work. Its scamming otherwise.

    So you scammed him basically? You knew it wouldn't work with his carrier and failed to mention this.

    I'm going to agree with Corey here, you'd better start making sense and actually telling the whole part of it or you're going to sound like a right cunt. As it sounds now the mistake you made wasn't selling him a phone that doesn't work or giving out your address on Craigslist of all places, but failure to mention it may not function with his carrier.

    Don't know how things are in your country, but in MY country, it's okay.
    Yeah it's morally wrong and I wouldn't do it, but during second-hand trades, it is up to the buyer to make sure that everything is okay with what he is buying.

    It might have been a problem if he asked you if it worked with his carrier, you said yes, and there's recorded evidence that shows that you said it but if not, too bad for the buyer :/

    So as long as you didn't lie about anything, you'll be fine.

    If it were like how it is in my country.

    Buyer should have checked out that it was actually working, but in this case this is scamming.

    Legally, or morally?
    Is a situation like this okay, since OP never said that the phone could be used using AT&T as a carrier carrier?
    In Korea, if you're not a licensed businessman who pays related taxes, you are not obliged to give people refunds.

    If this is not the case in your country, I envy you and the country that you live in.

    Refunds is one thing, but false advertising an item, taking money for it and providing something else is a fraud and it has severe punishments.

    If the person is willing enough, OP can face alot of trouble (However a simple refund is often the best solution here for OP (If the buyer contacts him again), so authorities doesnt get involved and it doesnt harm him in the long run

    Well though what you did was pretty messed up, I don't think you have anything to worry about. Unless you said it would work for him and offered the wrong information. If you just said selling iPhone for X amount and that's it, I wouldn't worry about it. But do try to be up front about what you're selling :p. This is why I only sell on Craigslist and don't buy.

    how is he not going to get in trouble on sythe for this? this shows a willingness to scam if presented the opportunity... almond this was a horrible thing to do, if someone else tested it on their phone and it didn't work why in gods name would you continue to try and sell it...?

    You can stop bringing "my country" up now, AT&T is not a Korean carrier, he obviously does not live there.

    I also wasn't aware California was in Korea, learn something knew every day I guess. It is scamming, no matter what way any country interprets it it will never change the clear dictionary definition of it.

    I'm not aware of every single cellphone carrier in the world and their countries,

    I made comparisons with my country under the assumption that we both loved in developted countries. In this case, there's nothing wrong with assuming that two OECD nations share the same or similar laws.

    I am asking for credible sources that what OP did was legally a crime.
    Me now knowing that OP lives in the states further raises my doubts that he will get into trouble for this.
    There were cases in the United States specifically, where people put up pictures of LCD TV's or other electronics on ebay with the description that the buyer will be buying what was displayed and of course, the seller was actually selling the pictures of the gadgets.
    Atrempts have been made to sue the sellers but failed because the seller hadn't lied about anything, he was selling what was being shown. He just didn't explain that it was a picture.

    The one person who WAS persecuted for such an act was persecuted because she posted the actual weight of the phone instead of the weight if the pictures. This was a case of misrepresentation.

    The burden of proof wasn't mine, but I took it to try to convince people that OP can't get into legal trouble for this. If you want, I can get the sources.

    I don't think this was a scam because buyer had my permission to test the phone out. For all we know, there are ways to unlocking devices for an iPhone and don't forget that we have Gevey SIM so it might be that he was trying to use it for T-Mobile, another carrier that doesn't require data plans. Also, I tried to keep him updated with my text messages but it seems about hes not responding to them which probably means he doesn't care about the device at all.
