Actually in the past people have still had to pay it back if the hacker was proven to scam someone while the sythe account wasn't banned. If the sythe account was already banned while the person was scammed and didn't get a PM then i think there's nothing that can be done.

BTW did you send a sythe PM to the user that was scammed by your hacker? Don't think you did but you still had to pay it back?
