If you have logs enabled on MSN messenger you'll at least need to take a picture of the XML log that is stored on your computer.

My Documents > My Recieved Files > History
Find the persons email and take pictures. If you cannot get pictures I would highly advise you to come up with any other conclusive evidence you can find.
