Legal Advice?

Right now, I received a summons for Juditionary hearing after Campus police searched my room and found a few things. A Juditionary review means it is not a criminal trial, if found guilty, I face punishment from the school and not the city.

My hearing is in 6 days, I have contacted a lawyer with 30+ years experience, and it is going to cost me $285 a hour.

The question is, should I just go in there by myself and take what they give me while being polite and holding my tongue? Or take the lawyer route and do whatever he says?

Here are some little facts:
1. Was not present in the room during the search, and yes they do have the right to search property owned by the school, not my personal items.

2. They mispelled my name on the Summons.

3. The cop's that did the search were not listed on the summons.

Offense/Reason for Contact: Possesion of Marijuana
Case Number: 20111029/0913
Charge Code: Sur Poss, Marijuana, Paraphenalia.

Narrative:

On 10/27/11 while assisting NSU campus housing department conduct a safety and welfare check, Reported items were found in the wall locker and desk drawer of the above student. Plastic container with Marijuana, (3) Lighters, (3) Bomb pipe's (1) smoked Cigar, (1) large, blue Bic Lighter, (1) Clear Mask for smoking.



Okay, now first off, I have no idea what a Bomb pipe is, Also I do not smoke cigars, so I don't know why there would be a smoked one there. I didn't think they could take my lighters, seeing as if they are legal, the Large Blue bic lighter wasn't even out of the box yet. The clear Mask for smoking wasn't a mask, it was a vaporizer bag. They also took a glass pipe, which had not been used forMarijuana, and was brand new.

They do not state the amount of Marijuana found. I have seen pictures that they took.

I meet with my lawyer Monday to discuss further, but I just wanted to see what you guy's think.

 

I would ask your lawyer what the biggest punishment they can get you with. And then ask your lawyer what the most common punishment they usually give with the same situation. And then I would compare the two and go which ever is lightest. I wouldnt want to be stuck paying a few thousand dollars for a lawyer who might or might not get you out of something. But I havent been in trouble and this is my advice. Good luck on whatever happens though. Shouldnt be anything to bad my sister gets caught with meth and worse drugs then weed and she is still around...

 

I would go with the lawyer route. I got done fdripped ding for the third time and because there was one mistake in the spelling of the model of my car the prosecutors fucked up and I got away with it.
It entirely depends, but if u have the money to pay for a lawyer I would definitely go for it dude.

 

You're lucky that you only have to face charges by the school. If you get caught with having paraphenalia or possession at my college we get turned right over to the police and are expelled.

So consider your self lucky, next i'd listen to the lawyer. He obviously knows what he is doing, otherwise he wouldnt be around for 30+ year and charge nearly 300 /hr. Also make sure you get your bowl back, if it has no residue on it, its 100% legal.

But Listen to gilbert, if the lawyer isn't going to help you, don't pay for one..I mean theres not much he can do , other then question the validity of the report..

But in the end man just hope for a girl judge and cry if you can.. If you watch weeds that'll mean something hahahaha. Good luck bro.

 

In the end, I do not mind receiving a punishment. I just don't want to get kicked out of the Dorms, if my lawyer can do that much then he is well worth the money.

 

Not true. If found with weed, they can still say it's use was for marijuana.

 

Oh my brother with out a doubt that is priority number 1. Staying on campus would undoubtedly my main worry as well.

The lawyer should be able to keep you on campus, if they did such a shitty job on the report, spelling name wrong etc not documenting how much was found.

Btw dude i keep my vape , water pipe and such at my friends house who doesn't live on campus.. = Win.

Also look into getting a stash can..The ones that look like a cleaning bottle of something but you can stash in there.. They look legit, PM if you want a link.

Waterpipes / Pipes / Bowls are legal with use of tobacco.

If it's clean its clean and cannot be held against you.

 

Nah, i read up on paraphernalia. Paraphernalia is anything that can be used to help sell/purchase/use illegal drugs. It's up to the judge if he/she suppose you'd use the piece for weed. If found with weed, it goes hand and hand, brahhh. The prosecutor will bring it up, and the judge will rule in favor of it being paraphernalia, most likely. Rolling papers could be considered paraphernalia with or without weed on it.

 

Wouldn't bother with the lawyer, what could he possibly do to get you out of that. He can't claim it was for medicinal purposes as that requires a license.

Besides it isn't that big of a deal. People get caught with minor drugs like marijuana all the time.
