You are talking about counterclaim, counter-suit, if you want to get technical about terms.

The OP is talking about a counter lawsuit, as in he is looking for a reason to sue jagex, as he has not been sued.

Counter-suit=Counter lawsuit. But as I said before, if he initializes the lawsuit then he is automatically on the hook for court costs unless the case can be won. This would provide an opportunity for Jages to counter

Not it doesn't sir, a counter lawsuit can be an unrelated lawsuit or a preemptive lawsuit to move from the defensive to the offensives.

Again you are trying to assume the two things are the same when they are not.

Honestly, if they wanted to sue you, you couldn't get out of it in any way -.-
If you're getting sued, get owned (y) , they're not gonna sue anyone for no reason, and they won't sue most botters, just the one's who are doing mass botting and affecting the game in a very negative way.

 

Except they have no grounds to sue the botters, the botting companies maybe (courts seem to disagree in the past), but by botting you broke no LAWS!

Again can you point out the laws botters broke? There's nothing in the DMCA that talks about cheating a game, or macro'ing a game.

 

You are arguably circumventing systems that control access to a product by using a bot, thus breaking the DMCA (if you are a US citizen).

Just because you did not make the program you are using, does not mean you are not responsible for any laws broken as a result of using it.

Have you guys been keeping up with the lawsuit jagex has against iBot? I just skimmed the opinion and it looks like Jagex is getting pwned, the District Court in Mass. held:

Jagex Ltd. v. Impulse Software, 750 F. Supp. 2d 228 (D. Mass. 2010)

nice thread, imo if it was rsbots or ibot software you brought, that jagex are on about i suggest you read what rsbots.org has said (here: http://www.rsbots.net/forums/index.php?topic=272524.0)
because it seems a sound case that its threats and harassment and the information was obtained illegally meaning the wont be aloud to use it in a court of law... (i cant explain things well just read the post)

 

Jagex's lawyers clearly didn't do a very good job trying to understand the laws they were claiming "botters and botting companies broke", especially considering that the US laws are entirely different than that of the UK. Jagex can't do shit except get reverse cowgirl'd at this point.

There is a lawsuit against jagex right now being held in the district court that i live by, they are being sued for illegally shutting down the botting software or some shit like that, it's a 24 page document. Seems pretty damn legit, i'm going to ask my Constitutional Law teacher if i can get a waver from school to go sit in on the case.
