    Legal Advice/Help

Last Saturday I was pulled over and received a DUI. I am under 21. From what I know my license will be suspended for a year after ten days from the arrest. I was also accused of being high at the time, when I have not smoked in over two weeks. I had to do a urine test, thing is I know it will obviously show THC present since it takes a hell lot longer than two weeks for THC to go away.

I have a feeling they will try using that against me, I'm thinking of getting an attorney if they do.

My questions is is there anything else I can do to lower the fines/sentence? What should I expect.

    I am from California.

Thanks, if this is not the correct section please move.

Offer to go to AA and if you do test positive on the urine test, a drug councilling group as well (w/e the acronym is for that)...They might make you do that anyways, but that has helped my old school mates.

The fine should be kind of steep, California has some of the most expensive fines for stuff. In Idaho if you get fined for something it is only like $12 (but they put your name in the news paper).

I have a medical marijuana card. The reason they said I was high was because my friends we're stoned.

    Lucky, wish this was Idaho.

I guess I better start saving up.

Instead of asking an internet forum, why not try consulting with a solicitor who specialises in traffic offences? They usually offer 30minutes to an hour's free time.

Firstly, this was an incredibly irrisponsible and silly thing to do.

As to "What can I Expect?"
Expect a tonne of speeches about how doing this was reckless, ect.
Expect a Heavy fine, proberbly in the thousands.
All i can say is im glad you had your seat belt on at the time.

If you ever feel down about this, think its better to be pulled over and lose your licence then to accidently kill a passenger in your car or pedestrian.

It is the worst guilt anyone can ever possibly imagine.

DUI's usually cost about $10,000-$15,000 after all is said and done.

    Look for mitigating circumstances.

Your medical marijuana card is one of them.

As for driving under the influence, how much where you over the limit by?

I don't know the California law, but in Georgia, a DUI will usually get you 12 months probation with drug tests, a drug and alcohol awareness class, 40 hours community service, and around a $1,000 fine on top of probation fees, court fees, etc. You probably won't lose your license unless you have past charges. A lot depends on what your BAC was. If you failed a drug test, it shouldn't really be much of an issue since they can't prove you were high at the time you got pulled over and especially since you have a medical marijuana card. Even once you are on probation, they will give you at least 30 days before they start drug testing. If you can afford a lawyer, go for it. A good lawyer will charge $1,500+ for a DUI case, but he may be able to greatly reduce your punishment.
