Storm - Burak (Abusive Ban)

With respect, our Terms of Service clearly state that bans for community guideline violations are not refundable. This is standard across software platforms. Sythe staff are not in a position to rewrite our ToS or simply ignore that they exist, and we do not accept liability where the customer violated them.

While we made a goodwill offer (50%), a full refund is not acceptable. This customer has over 274,000+ results on our Activity Logs. They've used this plugin over a period of months to make thousands for themselves.

Mentioning other staff members and historic incidents is not a valid reason to provide, especially when they weren't involved in this.

I'm not refusing anything at this stage, I would like to discuss this further, as I truly believe you're basing your outcome on previous incidents, instead of what's happened here.

I would also like to appeal this ruling/decision, and escalate this higher.

I feel this result is extremely biased, given that you’ve mentioned staff which had no involvement in this and historic incidents.

You are asking us to break our own ToS, which does not set a good precedent for our customers.

EDIT: I acknowledge in some cases that staff reserve the right to overrule ToS in clear instances of foul play.

However, this should only be used in exceptions, and shouldn’t be the instant go-to for all cases. In these instances, it would be great to see the reasoning for that decision, as to avoid arbitrariness.

 

It also seems that ToS might be a foreign concept to some of your staff, as here they are openly breaking them in a public chat, discussing and allowing derogatory terms/slurs. Disgusting.

With respect, "While we made a goodwill offer (50%)" You asked me to take a 200+ euro loss, take a further week punishment inside of your server, and remove evidence from this report, there was no "good will", you're only trying to damage control your own reputation for your staff/team members being abusive/toxic.

I would like to take a quotation from your own messages "I wasn’t around when this all happened, and when you were banned, it deleted all your messages so I have zero context."

A full refund will not be given. If the customer wants to accept our offer of a 50% refund, we will happily do this.

I won't be pressured into breaking our ToS which the customer agreed to prior to making the transaction, and you have no authority to dictate this.
