Quite true. Also, if you read this, Blizzard sued some goldfarmers a while back. However, it was NOT for selling gold, it was for hacking into their server and spamming all of the online members about their services that were against WOW rules.

 

Goldfarming is in violation of the TOS. As I stated before, United States federal courts have uphead TOS as an agreement. You, first of all, can be banned. This is not disputable.

If, during the douse of using Jagex's product, Runescape, you violate their TOS knowingly and with intent, you are liable for any financial damages from the resulting actions.

The reasons there have been no high-profile Runescape cases is because nobody has made it worth Jagex's time or given them enough evidence to prosecute, and big cases would scare botter away.

Simply put goldfarming and selling are illegal, although it is highly unlikely any consequences outside of Runescape will be due to your actions.

 

Gold farming was never illegal, and no company in their right mind would sue for Goldfarming, unless it was a site the size of usfine, etc. Even still, I highly doubt they'd sue as it would entail a frivolous lawsuit.

Also a problem with your find is this.

Having agreed upon the fact that you do not own such property:

You are selling items that you do not own, which is illegal. There is only one I know where this is acceptable, and it occurs on eBay, where people put items up for listing, then order from companies to ship directly to the address. I forgot what this was called though. Short selling is another, however it is illegal in some form, and countries.

That being said, selling property you do not own is illegal. Nice try with your find, however you invoke another illegality.

I don't think these mmorpg companies are ready to declare gold farming illegal. As far as I am concerned it is against ToS, but definitely doesn't fall out of boundaries with any international law. Therefore I can not be prosecuted for it, they can ban my accounts delete my gold etc etc however.

Besides the games a boring grind let's face it, and if my bots can farm gold so a bunch of kids can enjoy their game then they should be happy. I pay membership fee's anyways.

The point I am making is simply.
You are responsible for any damages you cause to Jagex while in violation of the TOS you agreed to.
The reason companies like Jagex or Blizzard don't crack down on gold sellers is because they gain so much money from them, and it's logistically impossible, not because goldfarming is illegal.

 

They won't declare it illegal, but it is committing fraud. You are knowingly violating their TOS with malice. Unless you are generating and selling massive amounts of gold, you will not have a lawsuit filed against you.

Jagex won't touch you with international law, they'll touch you with American. You agreed to an American contract, under American law, using an American response. It's fraud. Sorry.
