    In short, my employers are a pack of useless arseholes.

    They constantly mess up my wages, last week they only paid me half of what I should have got. Also note, I had my car insurance direct debit coming out that same night and was relying on my wages to cover it (which they didn't, cause they only paid me half)
    I rang up and the woman who does the salaries told me that she was away all week and must have calculated it wrong. She said that the difference would be paid onto my wages next week.

    I was later told that she "estimated" everybodys wages.. and anybody who had worked any hours on top of their set hours woud not have been counted in this week's wages. Yet, I only worked my set hours which I do every week and somehow they can't calculate that shit properly?

    Roll on to next week.. and they didn't pay me that bit from last week that they owed me. So when I ring up tomorrow, they are going to tell me sorry, bla bla.. we'll pay it next week.

    I was relying on that money this week again.
    I'm not sure where I stand.. surely they can't be allowed to underpay me without first informing me?

    Also, there wasn't enough money in my account for the car insurance direct debit.. so my bank paid it in the form of an unauthorised overdraft, which will end up costing me 50 pounds in bank charges.

    Is it just a case of tough luck or should my employer be compensating me for the costs incurred by their mistake?

    What is Minimum wage for your state? If they don't pay you minimum wage or more per hour, then its against the law and you can sue them

    They should definitely compensate you as they "calculated" it wrong.

    I'm assuming since you said "Pounds" for money that you're in the UK? If so, what is the minimum wage their?

    I have no clue what the laws are there on minimum wage but in the U.S you can sue them for not paying you what's required.

    As I said before, they SHOULD compensate you because they're ripping you off by not paying you what you worked.

    Yes, you should be compensated. Don't you have a punch-in system? Where it logs the time you've arrived to work and when you've left? If so, there's your proof and either way you should be compensated and if not you could take legal actions til they do.

    if you sue the place where you work, wont you get fired? also it will be hard to get a job no? your employer would just say hell no this guy might sue me like he did to his ex employers!

    thats my theory and opinion

    It's illegal to take ANY action against someone for legal complaints.

    Going to cost you your job/company if you try to penalize someone for that. ;)

    If they keep messing up your pay rolls, phone/talk to the boss or someone who handles the money and make sure they don't do it again. If they do, file a complaint against them, possibly sue them and earn some money that you do deserve.

    If you're not up to sueing them and they keep doing this, find another job and quit your current one, but make sure you do find the better job first otherwise you don't want to be jobless.

    No, that's discrimination and equally punishable though the employer could blame it on other bullshit reasons. Besides, they wouldn't know unless YOU tell them (or it was that big that it ended up in the newspapers).

    Actually, if an employer in the future sees that he did that, it would drastically reduce his chances, if not completely disqualifying him. (I know a guy.) ((I also have management and hiring experience))

    Yes, we do.. but I think it's only used so they can see how long you took for break/lunch etc.. and if you clocked in late to start your shift (so they can deduct more money from you).

    Thanks to all who replied.. what do you think my chances are of getting the money back from the bank charges? Am I actually entitled to that?
    I know i will get the extra they owed me (eventually).. but it has cost me alot for their mistakes.

    I'm not really interested in suing them, but if I can find what law they are breaking, i'll happily scare them with threats of legal action to stress them out a bit, let them know how it feels :D

    ..and Hayden, that's interesting.. I'd well believe that employers would quietly push your application to the bottom of the pile if they knew about previous claims. But the question is, how would they know?
