You wont lose, the police and his family agreed on payment by Wednesday, which was not met. Forfeiting the laptop to YOU.

 

While it may not make a difference, situation may change from those mentioned in Sythe's thread as said "social contract" was with a minor.

 

I like this idea. But I don't think I'd have the courage to be quit in court.

The only problem with what is quoted above is that the police are involved.. And they make have records of you saying you have it etc. But on the flip side, they should have records on the family saying they'll pay you bye Wednesday. So, I would recommended using the police to your advantage. Use them as a witness in your defense. In the end, you'll probably end up owing them the 400$ and them paying you the 160$ out of that.

 

EVIDENCE IS EVERYTHING.. do you have a lawyer yet? he should help you out.. go to legal aid.. its free lol.. just say i agreed with the police to receive payment * by this day.. wednesday?* and you didnt so you sold. Also turn it around on them and try and charge them for harrasement for calling and bugging you and having you sued after you told them not to call and to have payment by a certain date.

 

So let me get this right, You told the police when they came to your door that you would give the laptop back after they paid what they owed you. Or else you would sell it, Therefore you made a verbal agreement. I think the outcome will be (if you can prove you did sell his laptop for $400) That you will have to pay him $240 then keep $160 for yourself.

did anybody else besides you and the kid know about all the time and warnings you gave him? because if so i would ask them to get involved

 

Find any records you have that you repeatedly told the kid and the rest of his family to pay you and pick up his laptop.

First of all sorry for my bad english.
You will lose the cord and will need to pay the price for a new laptop for sure. Example: I bring my laptop to a actual real laptop making service. I don't pay. They can keep the laptop till I payed but not sell them since it's not theirs.

The laptop was not yours to sell and you can not add terms to a verbal agreement after the fact, especially ones imposed by yourself unless you previously protected your right to do so somewhere your verbal agreement.

You handled the situation incorrectly and although you did have just right to sue for the amount owed to you via the verbal agreement, you did not have the right to sell his laptop.

He wasted his time and money on it and he did not get paid and they did not bother to pick it up, so he got what he spent in it and got out.

I understand what you done by selling the laptop cause he did not pay you the sum of money he owed you, however all in all you should not have sold the laptop at all since its not registered in your name and you dont have a reciept, although that kid seems a right D1ck and his family seem poor or just plain stupid, they do have the right to attempt to sue you because afterall the laptop is legally theres.

also you should have sent a written letter with what you want and need and when by e.t.c and kept a letter yourself as this is a very good way to show you gave them many chances and alot of time to pay you.
