Legalish help?

Okay say I called my teacher an inappropriate name on Facebook, and if I didn't delete it would he be able to charge me for that? >_> If he can't would anyone link me to like a site proving it?

 

um.. i dont he will charge u for it, but school admins might give you some shit for it.

 

Well, I've been through the Terms of facebook, and only 2 were even remotely close to it.
Also he threatened if I didn't delete it, I deleted it. I hate him I just wanna prove him wrong. XD

 

You could use "My teacher" in place of his actual name. There isn't shit he can do.

 

Well a lot of people think that Freedom of Speech protects them to say whatever they want about any person or any thing, when this is not the case. It protects your speech against the government, and not much else. Saying things about other people can get you in trouble, and can be considered libel.

 

Or defamation.

I'd say just delete it, it won't lead to anything good. You'll probably get in some form of trouble, like suspended.

 

Correct me if I'm wrong, but I thought defamation was the act of intentionally attacking someone's reputation through means such as lying about something dealing with them, etc. not necessarily calling them a name.

Seriously, correct me if I'm wrong. I'm not too knowledgeable on the law.

 

I'm not sure on the legal point of view. But i can tell you if it's even remotely bad you can get suspended from school (depending on the school). I can think of multiple instances in my school where similar situations have happened and the student suspended.

 

I personally know my school wont take the time and have the follow through to do anything to you for something like that.

 

He didn't tell us what he said. For all I know, he could have called him a child molester, which would be defamation.

Hmm... I'm not really sure if he would be able to charge you for that. I remember a while ago I heard about a girl creating a facebook page saying something like "I hate my Math teacher". One of the teachers/administrators found out about it, and she was suspend for three days. After that she took the case to court saying that this was against the first amendment (Freedom of speech) and she later won the court case.

I'm really not sure if the same rules apply in your case, but I wouldn't wait and find out. If possible, delete the post before possible getting into trouble. It's really not worth the chance to be honest.

At my girlfriend's school, a teacher threatened to inform the police that the students were using Skype on their school-issued laptops, and told them how it's a federal crime and whatnot.

Don't believe it. It's pure bullshit.

 

Yea, it was a pretty pointless case. I didn't even think that it would go through, but it did. It's a pretty good point for this topic though.

 

If this really got to be a lawsuit, deleting something won't change anything. You get emails when someone comments on your status, etc, and the content mentioned.

What did you call your teacher? They could sue you for sexual harassment had the phrase been sexual.
