Someone Breaks into your Home, Do you have the right to kill them?

Im sketchy about it.

 

In my country you can. Really depends who it is and if they attack you first.

 

Due to the bill of rights you have the ability to defend your home. If they are on your property in your home You have the right to defend it.

how would you really know who it is...

I mean if the guy had any weapon on him which in most scenarios he would i think its safe to say it`s ok...

Recently a guy protected his family from a bugler in my area and he killed the thief now hes sentenced to 5 years in prison which is pretty funny LOL

Well of course you would defend but would you go as far as to murder the guy

You would probably be fine in court either way, but you should tell them to get out first, then if they don't go ahead and attack.

It's an entirely different situation though if you have a family and don't want to wait around for him to pull a gun on you, then you probably just go for it and attack.

 

Hm, i dont think you will get away with killing them (not where i am anyway) but if they chose to come into my house, i would attempt to kill them or try to

Maybe take them down by hitting them would be okay, but in the UK, I'm pretty sure it would be classed as man-slaughter.

A guy shot a man attempting to rob his house and got sentenced a few years. (Seven I believe) Though if the burglar had a weapon, I'm sure it would've been a whole new story.

 

You have the rights to use necessary force. For example, if they have anything that can kill you such as a knife, gun, etc, you do have the right to kill them. But if they're just there to steal, you can not kill them. You can use necessary force to stop them without killing them.

 

I think with this kind of thing you are allowed to use the minimum amount of force required to make them stop doing whatever they are doing. Eg. If the burglar attacks you, you are only allowed to hit him until he stops trying to attack you.

 

Depends what the situation is, if you catch them and they freeze and stop then you shoot/stab then no. If they have a gun and are firing then your protecting your self.

 

Isn't killing a little.. overkill? Try knocking him out, or just disarm him and wait for the police to come..

If you managed to disarm the burglar.. Why the hell would you keep beating him up?

 

You have a right to defend you home, but you cannot kill them unless they strike at you. Since it's your private properly the worst you can do unless they start something is just tell them to move off your land and call the police.

 

Nope, you have the right. You don't know their intentions upon entering your house. If I hear someone breaking into my house, I won't hesitate to grab the shotgun in the corner of my room.

It isn't over-kill... Hell they could be coming to kill you, why risk it?

 

This is correct. I believe in the United States (where I live), you can shoot to kill if someone is breaking into your house, if they pose a threat.

But you can only shoot/stab them in the stomach. Because if you shoot them in the back, then they're obviously running from you, so they're not a threat. Apparently they look for where you shot them when determining if you had the right.

 

Upon killing someone in your home, you have to provide proof that it was self defense/probable cause. It's possible to be taken to court for 2cd Degree Murder, etc.

 

I really believe if you have probable cause that your life is in danger then you should have the right to do what is necessary to defend yourself whether it be knocking them out or killing them
