    Where do you live, because in Australia that is against the law and school can be fined around 15 - 20 thousand dollars.

    the bottom line for me was that i never gave up my phone. I got caught with it in detention one day a few years ago and they teacher and dean were asking for my phone but i wouldn't give it up so they told me to leave detention, which would have been a week suspension if i didn't serve it. i refused to leave the detention room or give my phone back and they had the rent-a-cop come in and escort me out. i got suspended for 2 weeks for insubordination

    My school can and will punish for out-of-school activities. I was suspended for 5 days for texting about smoking at a friend's house. Of course, they looked through my phone, which is illegal I presume, and found that information out.

    My dealer Billy was actually suspended for 5 days as well on the most recently passed Monday. He had half an ounce on him. Someone got their phone taken away, the teachers looked through it, reported him, bam. He's out half an ounce AND suspended.

    I know many people have been suspended for talking about out-of-school activities, particularly fights. I also know of a personal friend who was expelled for having a large collection of nudes. I even know of girls who have been suspended and/or expelled for sending nudes.

    I've had a number of teachers threaten to take my iPod away because it's a "distraction", which is bogus. Fiddling through it to find a song isn't a distraction, it's to help me stay on task.

    Schools need a set of laws so they can't do as they please. I'm tired of ridiculous shit.

    I got to a school where u can use your phones anytime outside of class. Ie pass peroid, lunch, ect.

    Just put a password on your phone.. My phone has a 4 digit password, and locks for an hour after so many attempts. <3 iPhone :)

    Honestly, they shouldnt be able to search it, and i do think thats stupid

    You're the one that is mentally challenged, no offence.

    People have been suspended at my school (prior to my expulsion in January, so..I don't go to school anymore), for MUCH less than discussion of illegal narcotics, use, and substance abuse.

    For possession of child pornography (any age under 18, in some areas, under the age of 21), you could not only get suspended, but expelled indefinitely, and possibly sent to a juvenile facility (or if you're 17+, you could be sentenced to prison and be forced to register yourself as a sex offender for the rest of your life.)

    The school administration absolutely have NO right to troll through your private life like that.
    If they promised that they would not do so but did, then you have the right to take legal action against them.

    Teachers do have the power to take your phone if it is against the rules as well as searching a person for malicious content (porn, drugs, alcohol, etc.) - They are limited to searching the persons clothing and backpacks as well as lockers but they can not look through a person's phone without any type of court order as this is an invasion of privacy.

    It would be just like searching someone's home without a warrant/probable cause.

    Lucky me my school is only strict on phones/ipods for the first 2 weeks. After that they just don't care. Or they do but have other more important things to take care of.

    Such as dealing with fights, budgets, meetings, ect. Stuff that's more important that a friggen phone or ipod.

    Its bullshit. They should not be able to get you in trouble for what happens off school grounds, and off school property (computers and internet, ect.).

    My old school was fucked up....Didn't care so much about iPods, but they were crazy about phones. Got mine taken up one day, I took the battery before I gave it up....got called into the office asking what I had to hide by taking the battery out..

    My friend's background on his phone said "FUCK MR. BERRY"(Principal), and he got it taken up on purpose. It was the first time he got it taken up(first offense they keep it for 10 days). The next day he got assigned 10 days of morning detention for the background.

    Love my school, most of our teachers are cool and let us play on our iPhones if we want after we do work. They're also allowed at lunch too :p

    At my school if you get your phone taken away you don't get it back till Friday, but if you get it taken away on Friday, you don't get it back till the next friday:\

    Or untill a parent comes and picks it up.

    Schools reserve certain rights that you agree to (or your parents do for you) by attending that school. It depends on the school and country what can and can not be done with confiscated phones but in most cases you have already agreed to let them search your phone by attending the school. The same thing applies for student drivers who park their car on campus. Many schools have it in something you or your parents sign that says that they have the right to search your car for any reason and not letting them do so could result in some sort of punishment or expulsion.

    So basically, by attending school you are waiving many of your rights that you would have outside of school and it is extremely stupid, but unless there are laws passed saying that schools can not do things like that, they still will be able to.

    No. Schools sometimes think they are their own government. I have much more to say... but no, they shouldnt be able to do anything.
