    Should a person be put back into jail if...

    Should a person be put back into jail if they've proved they're innocent after being convicted?

    Here's an example:
    Bob was arrested one day for robbing a bank. Bob failed to prove his innocence in court, and was sentenced to 25 years in prison. While in prison, Bob thought up of a way to prove that he's innocent. Bob breaks out of jail, and proves he's innocent.

    The court finds Bob innocent in the initial case, but escaping jail is a crime!

    Should Bob be put back into jail because he broke out?

    He should serve his time for escaping, but he'd be cleared of his original crime.


    Why couldn't Bob just talk to his lawyer?

    Bob should have brought in his lawyer and appealed. He should be tried for escaping the jail.

    Pardoned on the fact he did not rob the bank, tried on the fact he broke out of jail.

    He should be pardoned on both parts, as it was the government's mistake in the first place and they should forgive him for breaking out.

    Nope Pardoned on Both accounts, because if he wasn't wrongly convicted in the first place he would of never been in jail. But Since he originally broke out of jail I doubt a court would listen to anything he has to say regarding the matter.

    Agreed. And this happens all the time, exept for the escaping part lol. but i read recently a man served ten years for a rape he didnt commit and was just released do to dna evidence he even tried to appeal or whatever like 10 times.

    Anyone who thinks he should serve extra time is a total MORON!

    Of course not! The state would get sued billions of dollars alone just for making an innocent person get put in prison for 10 years, imagine 25!!!

    You Cannot be tried for the same crime twice, so if he were called innocent and he really did rob the bank, he could walk up to the judge and say "Hey I robbed that bank" and the judge cannot do anything about it. I DO NOT think he should be tried for breaking out, because he was doing it to prove his innocence, and if they don't want him to break out, then they should have made the jail better. That is all there is to it.

    He would probably get longer for breaking out lol... Yes back to jail..
