Statutory Rape Help

Quick question. Okay, so I know a girl who's 13 years old and recently had sex with a guy who's 17 years old. Basically, he was giving her a ride home when he told her to get into the back of his truck. She replied no, take me home, and he told her to get in the back of the truck a second time. After he told her to a second time, she did it and of course they ended up having sex. Now my question is, could this be considered statutory rape or corruption of a minor? Thanks for helping.

 

Its statutory rape if she consented, its rape to the 1st degree if it was by force. Even with statutory rape you could do ALOT OF TIME, and will be on the sex offenders list for ever. You are not allowed to have sex untill 16 years of age.

 

What state do you live in, statutory rape age consent is different in each state.

 

Pretty sure no state has a law in which 13 is legal.

39-13-506. Statutory rape.Statute text

(a) Statutory rape is sexual penetration of a victim by the defendant or of the defendant by the victim when the victim is at least thirteen (13) but less than eighteen (18) years of age and the defendant is at least four (4) years older than the victim.

(b) If the person accused of statutory rape is under eighteen (18) years of age, such a defendant shall be tried as a juvenile and shall not be transferred for trial as an adult.

(c) Statutory rape is a Class E felony. 39-13-507.




So, it is Statutory rape in any way.

Well theres No Proof then if it went to court it would be thrown out becuse Of lack of evidence thats here in the Uk anways .

 

Well she can say he did do it with her... i mean...she can take a lie detector test..and obviously shes not lieing...so he could go to jail for...having sex with a minor.

 

Well even if they both have sex willingly it is still illegal and you can both be punished I suggest she get a STD and pregnancy test, call the police, and if possible do not shower yet (So the police have evidence)

 

Well, there's no evidence so I don't think you can do anything about it.

 

Lie detectors aren't admissable in court. She can't prove it without going to the police straight away and getting a medical, the only way he'l fall is with a confession.
