Can someone clarify this for me

So, this guy scammed me and owes me $115. He's saying his msn was hacked, I don't believe it but it's possible.

What is going to happen here? I know the rules say he has to pay me back, blah blah blah but since he had "im msn hacked" in his signature, and I didn't notice it will I be reprimanded for this or will he at least be banned?

I've never been in this situation before.

 

He'll be banned if he doesn't repay you. There was a similar situation with Unb4nn3d recently, and he was still expected to pay back what was scammed because he was responsible for being hacked.
