Explanation of the discussion:

I'm currently admin in the staking server "Elite Ranks", Begin december 5wap sold the server to a guy called Cryalics (Cryalics#6912 - UID: 1060323622058729493).

Cryalics and I made a deal: if I sell him $5k worth of wallet I would get $1k, this deal was from January 1st till January 14th. In the period of January 1st till January 5th I already sold over $3.8k worth of wallet..

Till Cryalics sold the server back to 5wap on the 5th of January.
Since the deal wasnt finished we agreed on him owing me $650 since I was about to complete my part of the deal. He paid me $150 so $500 was left.

During Cryalics his ownership he paid a dev (Named Malcolm: Malcolm#7178 - UID: 216026953130573824) $450 as prepayment for a $900 job which he was going to refund cause the dev said there will be a delay of 1month.

Cryalics asked the dev to refund the $450 and send me the money as replacement for the $500 he owed me.

But 5wap refused the refund cause he says the $450 is now his instead of Cryalics' and he agreed on the dev waiting for 1 month till he can continue his job.

The question now is: Should I get this $450 of the dev or what else should happen?

Sadly our Server got banned, together with my discord account (and 5waps and Cryalics), we all made new accounts so the tags and uid's provided above are valid.

But because this, there is no proof of the actual deal but we are all aware that it happened and this is not the point of the report.

Just chiming in here as I am the developer of this. When I knew I was going to be delayed, I offered the refund. Screenshots below.



I am more than happy to provide a refund, however, I was also told in a separate DM that 5WAP (RSCrown) did not want it refunded, but he's not the one who paid. That screenshot is below (convo is somewhat redacted as we talked about other things that we have done business with in the past as well before I received that message. Also, this is a new discord as I believe RSCrown's discord was banned.



Again, I am more than happy to provide the refund as I know that the delay is unexpected and I don't think the customer should have to wait when I gave an original timeline.

 

Just let me know if/who to refund and I'm more than happy to do that

I already said I do not want a refund and I'm happy for Malcom to continue working. Even if he needs more time. The money paid to Malcom I took into account when me and cryalics agreed on how much I would pay for the server.

I factored in the $450 paid, as well as anything else that was purchased. A new discord gambling bot was purchased, but that is included when I say "I get anything related to elite".

Imagine you own a shop and you then put $500 of your own money in to purchase inventory for the shop, the delivery is from china and there are some delays, it will take 2 weeks longer than you thought. But in that time you sold your shop, the delivery is still on the way, the new owner of the shop has taken the inventory into account when making a deal regarding the price he/she will pay for the shop. The previous owner could not then say "actually cancel that, and let me get my $500 back" to whoever they were buying their merchandise from.

I purchased the server and everything that has been paid for, all of the bots, the discord, the website, everything. Along with that I also took on all of the wallets.

There is probably around 400b rs3 in wallets as debt that I'm taking on. Now I'm more than happy to have wolfie get the $450 if cryalics wants to pay for the current wallets in elite ranks.

 

While I was sleeping, Cryalics mentioned again Malclom to refund me the $450.



Having this said, Cryalics is aware of the Sythe discussion here, but sadly doesn't want to make a Sythe account to get involved in this discussion.

 

And again, I would like to mention that this isn't a scammer report or something!
This is just a discussion we had and we couldn't solve it, thats why we are using Sythe for this.
No dnt's have to be given or something...

Cryalics still claiming the $450 he sent to Malcolm, is his and isn't 5waps.

 

I think the question that gets asked/answered here is this:
If the bot was completed at this stage and operating in the server, would you expect to remove the bot from the server when the server was sold?

I'm an accountant full time and if this is treated like selling a business, you sell the balance sheet of that business (assets, liabilities and owners equity), and receivables fall into the category of assets (which is what the bot would be at this point).
Does this get treated the same? I'm not sure, I'm not the mod here

I'm not really sure what's going on with this part of the agreement as it has nothing to do with me:

But personally, I would think that the $500 would be owed to @Elite Wolfie in some way.
If @RS Crown doesn't want to pay that out then I can of course, send the $450 that I do have to Elite Wolfie and not complete development of the bot.

Also, if @Pirate chooses to rule that the WIP does actually belong to @Elite Wolfie then again, I'll send the $450 back to them.

Just let me know what the ruling is and I'll be sure to send the refund if required.

 

The bot was never "supposed to be scrapped" Malcom dmed the group chat we were all in after I purchased the server to say it would take longer.

I’ve had some unexpected shit and I’m going to be moving on the 16th so I have to prepare a move and might not be available for a while after that (depending on when I get internet access etc) I still have a lot of work that id need to do to compete this and instead of dragging this on, I’m just going to offer the refund.    I haven’t started the osrs script side. I have a wallet type function working as well as commands to add stakes, add funds, withdraw funds and a few other features. There’s still quite a bit of work for me to do and I’d either have to either ask for another month due to the move that I’m going to have to do, or just offer the refund

Not to me. I was made aware of this after. The deal cryalics made was "sell 5k in gold get 1k bonus". Once again I didn't know he had made that deal. Wolfie sold 2-3k worth. So the requirements for the deal had not been met.

Another point. I had taken into account the bot Malcom was making when purchasing the server, it had been agreed upon about a month ago. The amount paid for the bot is counted. You could not sell a pizza shop that had a pizza oven you bought 2 weeks ago and then after the sale of the shop get a refund for the oven. The oven is part of the shop.

 

Cryalics says that the costs of the dev wasn't included in the ownership transfer. That he paid it and that it belongs to him. And since he owes me money, he says that Malcolm should refund the costs and send it to me.

Correct me if I'm wrong, but I believe you're saying that @RS Crown owes @Elite Wolfie $500 due to being the new owner of the server and taking on the debt.

If that is the case, I'm more than happy to either send the $450 to @Elite Wolfie and @RS Crown would have to send him another $50, or, if @RS Crown doesn't want a refund, he would have to send @Elite Wolfie $500 for the debts of the server.

Can you please confirm that is the ruling?
If that is confirmed, I'll be more than happy to either send the $450 to @Elite Wolfie, or if @RS Crown doesn't want my refund and he want's to pay $500 himself, I think he'd be more than welcome to do that. If @RS Crown doesn't want to pay at all, then I'll hold the funds as an anti and send it anyways.
