If you can prove to me that these aren't phished, they won't be banned, and they are legit then i will buy one.

If the account holder contacts Microsoft, gives them all of the accounts original information and proves there identity/address, they can have Microsoft recover the gamertag after a long process and much paperwork. If the account has a registered credit card, then after the account holder recovers the account they have the opportunity to prosecute the person that phished his/her account. If the phiser used any of the money on the credit card to purchase games and/or microsoft points he/she will be facing federal charges depending on the amount spent, if $250+ it is a felony on top of credit card fraud.
