Does the fourth amendment apply in public schools.

I was wondering if the fourth amendment, illegal search and seizure, apply in public schools. Can you refuse to be searched in school?

 

I know that some schools, at the beginning of the school year, require that you forfeit some of your rights, and this may be one. Checking your schools requirements would help.

At my highschool, we do get searched and such. Usually only by a cop who comes every other day, but we have 2-3 on-campus security guards.
If you are caught on multiple occasions with "not-too-serious" items, you must sign a paper saying you can be strip searched without questions by a qualified officer.

 

Yes apparently if there's "reasonable suspicion" they can legally search you. Unfortunately that's such a loose term and could mean alot.

 

You can refuse, but.. you don't really have much of a choice. Here are some Supreme Court cases (not my work, found off a website, etc.).

It generally means even if they have a slight suspicion they can search you. Like even if there's a one out of ten chance you have the thing you're looking for they can still search you.

You have very little rights as a minor, especially when you're in school. Basically the school is allowed to violate your constitutional rights if they have the slightest feeling you're a "disruption and/or threat to the educational system". It's pathetic, but seeing as you can't vote politicians do not care.

You only get searched if they think you have stolen property, weapons, drugs etc.
