    How they scammed: I went first.
    Explanation of the trade:
    I joined JakeBird19’s (UID512678971649949726) and Aory’s (UID623928778585931817, now banned user from Sythe) services discord server. I hired JakeBird’s HCIM specialist to do a skilling service on my HCIM. I have both of those users confirming by scythe PM the order, if needed.

    When JakeBird failed to deliver the service on my account, causing me over 100m of loss on the account, on top of the 375m I paid him for the service, he refused to simply refund me the order that was barely started.

    I agreed to JakeBird’s TOS which states “We will not be held accountable for any lost wealth” and “We will not be held accountable for any loss of HCIM status”. Therefore, I want to state I understood I might lose the account if JakeBird failed the service. (Around 100m worth + set me back hundreds of hours of playtime)

    However, JakeBird was unable to deliver the service I paid him for of 99 firemaking on HCIM and other skills, which was stopped at not even 10% of the total completion in terms of time. JakeBird decided on his own to take a cut for the service he couldn't deliver while his ToS does not state that anywhere.
    JakeBird is not liable for my account value, but he is liable for not being able to fulfill his HCIM service. Therefore, independently from the account value as stated in his ToS, JakeBird should refund me the full order amount for that contract I hired him to do that he failed to execute.

    The total transaction is 375m and 305m has been paid back. JakeBird refused to give me the last 70m of my refund, stating that even if he could not deliver the order, he spent some time trying.

    I can provide any proof needed to follow up this case.

    Good evening,

    Firstly i would like to apologise this has even had to be disputed over sythe, we have tried to resolve this but clearly due to unrealistic requests we have had to resolve this here. I apologise we have had to take up your time!
    First thing i would like to make clear is Venezuela United is my discord and i am sole owner of this discord. I have chat moderators that help me with influx of customers, however all orders are received by myself and collected by myself hence this dispute should be solely on myself, not including my administrators.

    We have had to take this to Sythe due to unrealistic requests and thrown out comments after refunding said order. imgur.com .

    Please acknowledge above. To this end when ordering i also made it perfectly clear to him that we will not be responsible for HCIM deaths as stated in our terms of service, please find IMGUR attached. imgur.com . As seen he understands the risk and therefore completely unjust for this report.

    The order was as follows initially imgur.com. This was for 50-99 FM and 1-77 RC which initially came to 130h, 50h for firemaking and 80h for runecrafting. 390m or 195$. Reasonable request.

    As per all orders and especially of this size i was expecting some push back and eventually we agreed on the following imgur.com . 50-99 Firemaking, 1-77 RC and 1-50 Hunter for 370m, hence a large discount and much less than 130h. This would make firemaking less than 50h as seen as we discounted the order, regardless this isn't the point. We then decided to add 50-58 Hunter for 5m hence the pricing of 375m as seen in the initial Request.

    Sadly this HCIM sadly died, this is where the issue began. imgur.com . imgur.com . This is where the unrealistic request began. As seen above he was told on several occasions we are not responsible for HCIM deaths and he also point blankly accepted that.

    imgur.com . I felt due to his nature of being upset it was reasonable that we offered a refund of incomplete work. imgur.com . Due to feeling bad and trying to be kind in this situation i decided to refund all incomplete work - which i believe is completely fine. I refunded all except 25h as i took his word that the account had 92 firemaking, turns out our worker has got him 96 firemaking so he has ended up with a stupidly cheap 50-96 firemaking imgur.com , Therefore out of being fair i refunded him 300m. Thus taking off 70m which covered 25h firemaking (Which would of got him to 92 we actually got him to 96 so i shouldn't of refunded so much).

    To conclude we have provided our Terms of Service which he clearly agreed to, the sad event of an ironman death he agreed he understood the risks, we refunded what we did not complete on the order. Out of good faith we refunded extra as work completed was 50-96 firemaking costing him only 70m, which all services will know is crazy cheap for wintertodt.

    Hope this clears up, i have not scammed any money, this is less than what we actually completed.

    I would like to take the time to state the same to the mods reading this. I have thousands of dollars traded on Sythe with dozens of vouches to back those transactions, and this is the first time of my many transactions that I find myself in a situation with an ill faced seller, and where I have to come to this forum to write and explain all this. If any more evidence or information is needed just let me know.

    I agreed to your TOS and that is why I cannot say anything about the 100m+ you made me lose from that unique account's value. However, the ToS that I agreed to covers the account value, not the service that you were unable to deliver.

    As a side note, your ToS also states that "we will take precautions for these accounts accordingly". This was clearly not done by your negligent "hardcore ironman specialist" because he died a few hours in a skilling order. Also, the clause #3 of your ToS is clearly an abusive clause as the second part contradicts the first.

    We agreed to this as a whole service bundle, and you could not deliver my order, instead having me set back hundreds of hours. Also, I don't care that your worker spent a few hours on the account after he destroyed it. I will take the loss of the account, but billing me on top of that is just rubbing it in and not covered by your ToS.

    I offered you to make this right for everyone, and let you start over on a new account to deliver me the service as requested, and you refused. I was already losing a lot of money with this proposition, but chose to propose it to you as a gesture of goodwill.


    You clearly did not fill 25 hours.

    The worker worked for 10 days straight as seen on the time stamps hence reaching 96 firemaking. I think i am more than fair and in my rights to take off 70m for 50-96 firemaking. This is very low and actually i have been very generous in this refund.
    You agreed to our Terms of service which i have stated above. Sadly the ironman died, this is out of our hands, we cannot help nor stop random Disconnections. This is not a lack of negligence as i have worked with this worker on plenty of HCIM jobs before and seen completions of wintertodt without issues. This is an unfortunate event.

    You agreed to the ToS as per all services and i even reiterated this in the chat. I have posted all i need to on this and i think i've been extremely fair with my refund.

    I will leave this down to the admins now as this is the exact position we have got to in the transcript after hours of chatting. I've been very fair in this transaction, but i will not be walked over.

    I never ordered a 50-96 fm service on a normal ironman for 70m, and am not paying for this.

    And yes for the 10th time, I agreed to your ToS but it is stated in said ToS that it covers the account's value, not the service that you were unable to deliver (firemaking on HCIM). I understood I might lose the acc if you fail the service, but you charging me on top is a plain shakedown. You think that because you put time towards an order you failed, and that you shouldn't have taken in the first place, that you could take a cut while your ToS does not state you should take a cut on an order you cant deliver

    Also, that 70m that you should reimburse me is nothing compared to the loss I made on the account's value.

    While I understand your frustration @shimini2, ultimately you agreed to their ToS that you understand they wouldn't be liable in the case the slight chance the account loses its HCIM status during the order. Just because the account lost its status doesn't mean the amount of time spent on the order and/or the value of the account in whole should be completely reimbursed as that's unrealistic. He took the right approach in refunding you for the portion of incomplete work, therefore this has been resolved. In the future I suggest being more specific in the questions you have with your service provider beforehand to avoid disputes like this.
