Charges laid against EternalMage.

I am posting here in here in regards to a ban set in around about 1 and a 1/2 years ago. This ban was set against a user by the name of EternalMage. There is no proof that my client actually commited any offences, and we think that he may have not been in control of the account at the time. I also feel that the proof set wasn't clear enough, as he confuses his story. I base this on the following facts;

1) The I.p posted on the thread claiming that he scammed didn't match up, making it insufficent to prove that my client was in control of the account at the time of the "Offence".
2) The proof against him was not enough to cause a permanent ban, as they could of taken the pic of them first logging in on the account.

3) The accuser isn't clear on his accusations, as he says that he is using being keylogged as an example. You cannot prove my client did any of the accused.

I also beleive his ban was done in response to a fraud offence made by my client, and the ban was solely based on this. He does plead guilty to this charge, however, my client does believe that this claim in irrelevent in the outcome of other charges. My clients outcome should not be based on this fact, nor should it be influenced by it. I request this in order for a fair trial to be conducted

I believe the punishment given to my client was too severe, and I am requesting it get reviewed. My client has agreed to pay back anything that was scammed, and is willing to receive a Trade With Caution, as well as a "Do not trade" user rank. He believes that is the correct form of punishment, as it suits what happened. I believe the punishment served was based on the fraud charge, and not on the Scamming judgement.

All in all, my client is willing to do more than enough to get himself unbanned. He is more than willing to pay back any money that is stolen, and is willing to be restricted to selected forums. I ask that this matter be reviewed by a jury, and the outcome to be unanimous. I also request for this matter to be in accordance with laws at the time of offence, not of now.

Yes, I am a lawyer. If you have nothing to contribute to this case, please stay outside of the courtroom. As stated, the ban was unfair, and I feel that it should be reviewed.

 

We can't begin the prosecution until the defence makes up their mind.
