Yes. Theft of virtual items should be punishable, however, in the case of runescape item scamming, it shouldn't really count. The reason for this is that to accuse someone of that you'd also have to admit you were part of breaking the runescape TOS which is absolutely punishable, even though I doubt JaGeX would persue it.

I think there should be a limmit, then that's where the punishment gets into play.

The amount of GP that could be stolen. Say if you stole 1M, it would go un-noticed. But if it was 100M, then I'd say to take action.

Because they are selling tangible goods.

A theft is a theft. You can't be ok with one thing, and be against another when its the exact thing.

A theft maybe a theft, but I think the charges will be different if you steal $5 and if you steal $5000

Well of course, but you can't say that stealing 1m is ok, but stealing 100m is not ok. A theft is a theft if you believe in that.

    Theft of virtual goods.

But if you're talking about RSGP or any other ingame currency being worth $5 or $5000, it should not be punishable. And IF it was punishable, the same punishment should be applied for both 1m ingame currency or 100m, because ingame currency has no real value. It may be sold at the price of, let's say 500 usd, but it still has no real value.

My terminology for something in existence is: If it can be used, it exists.

Money has no value either; it's just a piece of paper. Why don't we make stealing money legal too?

    Theft of virtual goods.

Money did have a value in gold and it's state property. If you steal money, the state can punish you for it.

The same goes with ingame currency, if you steal it, the gaming company can punish you (like ban your account).

It's both illegal, but it's bullshit that the authorities can punish you for stealing ingame currency, since it holds no real value, unlike money.

    Theft of virtual goods.

The way I see it, it's the same as injuring someone, or someone being injured on your property. They're allowed to sue you, because they won't be able to work, I think it's called loss of income, but it's the same sort of principle I think, and should be punishable.

    It can't be touched though.

You can touch it though, so it exists. Stealing stuff that exists can get you in trouble.

Me stealing 2m from a kid isn't going to stop the 1m members from subscribing, i can tell you that.

    Theft of virtual goods.

That's what I said earlier. Virtual goods doesn't mean JUST game goods, and you shouldn't, which is why for example, Jagex, does not allow it.

Other virtual goods such as programs, and songs took time and effort to create and if someone just steals that (which almost everyone does), then they should be able to be sued which is why they ARE able to be sued.

On the other hand, if a Runescape trade takes place, and the seller sells let's say 100m for $500, and the buyer takes the money back, then the seller should be able to sue the buyer and Jagex should be able to sue both.

I thought you were saying it depends on what it is earlier?

    Theft of virtual goods.

Selling virtual goods, shouldn't be. Because in all reality, take runescape as an example. If a notrious runescape scammer scams over 500m, what happens if Runescape goes out of business tommorow. All of that would be for nothing, and no more proof of the case. If it's not real life, it should not be considered real law, in my opinion.

    Theft of virtual goods.

I believe i know what you mean by this, but correct me if im wrong. It is not tangible, so no.

Then you are saying that all virtual items should be sueable if stolen. It takes effort to get the items.

You can't say a person can get in trouble for stealing 100m, and not get in trouble for stealing 1m. Its irony at its best.
