How could he possibly be Infracted? His Signature is still within the Maximum size stated in the Rules, and many other people have nearly-exposed women in their Sigs.

If you're talking about the signature size, the mods haven't really been enforcing that much unless it's REALLY out of hand.

As for the banner, I'm pretty sure they like the chick as much as you do
