He isn't banned, DNT'd or TWC'd on either accounts. This is for reporting Ban evaders. As long as the two accounts aren't interfering between one another, he isn't breaking any rules.

I suggest you don't use a secondary account to act like the police. If someone is scamming, attempting to scam, then please use Report A Scammer to report it assuming you have enough evidence. Also read the stickies before you do.
