What is the dispute about?

I am a regular supplier of legalperson1 in path of exile.
we have since a year a relatively high sales volume every week. usually something around 500-700$.
we never had any issues before, which is why i trusted him.
i always go first in the trades and he pays me right after.
now he apparently accidentally sent 2 of my payments to a wrong person. I always copy paste him my paypal address but he managed to send to a wrong address.

27.4.18

-he sent a payment to the wrong person.
-i did not check the payment and realized the missing payment today (2.4.18 ), after he mentioned it
1.5.18:
-sold path of exile exalted orbs for 239,7$ to legalperson1
-first he sent the payment to the wrong person. i told him i didnt receive money, so he sent it to me.
2.5.18:
-sold path of exile exalted orbs for 396$ to legalperson1
-he did not send anything for 1 hour (usually he pays within 5 minutes)
-i asked about the payment, then he started arguing that he had paid me twice yesterday and will only send 396$-239,7$ = 156,3$
-he sent 156,3$

his main argument why he doesn't have to pay me fully is that he "believes" the other persons paypal account would be mine too. the reason to believe that is, that i didn't realize he didn't send me the payment on Saturday 27.4.18.
this is absolutely not acceptable, since i did not receive the payments twice at all. this mentioned paypal account is not mine.

I clearly posted him my correct paypal address with every single transaction we ever made. he probably got "tricked" by his browsers autofil function, so he ended up entering the wrong email address. but this is not my fault and not my business. i'm entitled to the full payment, as i have also fully delivered the exalted orbs as agreed.
that i was sloppy and did not check the payment from the 27.4.18 right away was a mistake. i just said "tyvm" after he said he "sent" the payment without checking.
I was busy and as well just trusted him, since we never had issues before.
But i should not need to defend myself for something that is clearly not my fault.
considering that he did not send anything until one hour after i started asking if there was a problem makes me believe this was a planned scam on the 2.5.18 to make up his own mistake.

The only solution to resolve this: he has to pay me properly. the full $454.7 USD.

I will write post in two part.
First describe what happened by time.
Second,what did we get after we think about things.

First part:
27.4.18
-sold path of exile exalted orbs for 215$ to legalperson1
-we sent 215usd at paypal and post sent at skype and he reply tyvm!
29.4.18
-sold path of exile exalted orbs for 258$ to legalperson1
-we sent 258usd at paypal and post sent at skype and he reply thank you!
1.5.18:
-sold path of exile exalted orbs for 239,7$ to legalperson1
-we sent 239.7 usd at paypal and post sent at skype
-he said he did not get the cash ,and then our staff checked our paypal,found the 239.7 usd sent to paypal address [email protected] name Thorsten Brants.
- staff dont know what happened.but he send another 239.7usd to paypal address [email protected]

2.5.18:
-sold path of exile exalted orbs for 396$ to legalperson1
- staff dont want to made the same mistake yesterday.Contact our account about the 239.7 usd we lost yesterday.
-We did not send anything for 1 hour
-We told him we think we had paid him twice yesterday and will only send 396$-239,7$ = 156,3$ today
-we sent 156,3usd.

Second part
What happed in that 1 hour?
The first thing we want to figure out is how do we send cash to paypal address [email protected]
We checked our skype and other online chat log.we dont find anything about [email protected].We found that email at paypal history.
We sent this paypal 215 usd at 27.4.18 Because he sold 215usd orb to us.
And he reply tyvm after we type sent at skype as usually.
We have deal a lot trade with him and other trader.
From our side .ppl reply ty or tyvm after we post sent(cash) at skype .it means the deal is completed done for both side.(buyer get the items. Seller got the cash)

And he did the same thing for the 258usd orb trade at 29.4.18.
Even at 1.5.18,he did not claim he don,t get the payment for 27.4.18 215usd.
Until 2.5.18,after we mention it.


We trust him as much as him trust us,that is why we sent 239.7 usd after we found that cash didnot sent to [email protected]
But we still dont know how did we send cash to [email protected] at that moment.

3.5.18
We made a call to paypal support.
They told us paypal account can linked to two email at the same time.
It happened when cash sent to Email A.but the paypal will show the cash sent to Email B.
They confirmed to me that [email protected] and [email protected] linked to one paypal.
I asked the support send me a email about that(the email is in Chinese,I will try to get English version if DiamondStarFall /Play-On-Top/any other moderator need it).
And I sent 0.01 usd to [email protected]. to see if it will changed to [email protected].
I made a video when i sent the 2 nd 0.01 usd.
ANd i sent 3rd 0.01 usd to check this again just few mins ago.

well great that they confirmed that.
Though NONE of those 2 emails are mine or linked to my paypal account.

As you can see on all the skype logs i provided, i always asked them to pay me on [email protected]
not on ANY other.


What you did here is basically send 1 cent multiple times to the wrong person. I do not own [email protected] and i do not own [email protected].
Nor I have i ever asked for a payment to any of those.
Sending money to [email protected] WILL NOT in any case change the name / email to any of the by legalperson1 mentioned email addresses or any other.
His "proof" does proof exactly nothing besides that he is either unable to read properly or that is trying to confuse everyone here with false information.
To me this is an intentional scam.

"Tyvm" means "thank you very much"
this is a polite way to speak and no confirmation in any way.
a legal deal is done as soon the payment transaction is correctly fullfilled. not a second before, no matter what anyone says.

always the one i ask to receive the payments. i do not know why you suddenly sent to someone else and claim it is still me, just because the first name of the person is the same as mine.
you made a mistake and now try to blame me for it.
a very dishonorable behvior.

It is me request u to post scam report at this website .plz remember that.
And same as other website .After I checked the sticky threads I don’t find any info about how to report dispute and how moderator handle dispute. how did they arbitrate dispute?
Are Pendulum the only person to arbitrate this dispute? Or there are few moderator work together to arbitrate dispute?

You have requested to make a scam report on this website. apparently with the intention to confuse more people with your shady tactics.
The dispute is handled in any forum the same way. Both parties submit all proofs on the matter and then the moderators make a decision.
I still do not see a single proof that you have sent the 2 questioned payments to my paypal address, which is [email protected].

I already admitted it was a mistake to not double check that i received the payment.
You are basically saying, because i did not check the payment right away, I am not entitled to receive it at all.
This is not how this works and you know it.
You are still trying to cover your own (or your employee's) mistake by blaming me.

The deal was:
- i deliver exalted

I have fulfilled my part of the deal. You have not.
And this is ALL that matters.

As I already stated, i was busy and just trusted you. You always sent the payment and I have not checked it properly. I just trusted your word and statement. That was my mistake.
Still, this does not change anything. You have not paid me the agreed amount of money to the agreed paypal account.

I said it before checking. Then I went to my paypal account (even for a completely unrelated reason) and realized no payment was done

I don't see why I even need to justify myself in front of you. It is not your business if i am busy or not.
As stated before I trusted you on the payment and did not check.
I receive many payments every day. I run multiple stores for multiple things. I run a company apart from RMT.
A done deal is something I dont think about anymore once I assume it is completed.
I just did not expect you not being able to send the money to the correct person.

Again, I don't need to justify myself when and how I check and log into my paypal account.
This time i just logged on the paypal account and recognized the missing payment. That's it. Reasons do not matter.

Of course, I logged multiple times into my paypal account after those deals. For multiple reasons and transactions. Those do not matter for you and are none of your business in any way.
As stated before - one more time - I did not check the transaction with you at the first place. I assumed it was done correctly. Why would I go to my paypal and double check it when I thought it was done?
I started double checking when you did start to argue that you will not pay the 2.5.18 deal completely.
Then I started checking every single payment we made. Not before, because I had no reason to.
And then I realized (after you even mentioned it).
27.4.18: 215$ and 2.5.18: 396$ HAVE NOT been paid to me.
(2.5.18 payment has been done partially - 156.3$ -> 239.7$ missing)
Total: 454,7$ Missing

In fact this is more then right. You have proven that you are a not to be trusted person without any common sense and honor.



We're having this discussion now since 3 days and you keep repeating the same INVALID argument.

Again for you - our deal was:

I don't want to know why and I don't see any reason to keep justifying myself for things that are clearly none of your business.

The fact that I checked the payments some days later IS NO REASON to not pay them to me. We had a deal and you know that.
I'm getting really annoyed that I have to waste so much time into this because of your incompetence.



Send me the full 454.7$ or deal with the bans on all 3 plattforms we have this dispute going.
Because this is how it should end.

 

The fact that you contacted me the 2.5.18 - AFTER what happened the day before - to make another deal with me clearly shows your fraudulent intention.
You did not try to talk with me about it. You took my exalted orbs and THEN told me you would not pay me fully.

This was planned beforehand.
It's a scam by texbook.
