should i report him for scammer?

hi people. this is mi history.

A guy contacted me via skype to buy from my rs07 gold..
all went good.

I checked him on sythe and hes a very trusted buyer so i didnt cared go first.. l all went fine.. he got all my cash and then he sent the btc to my address, "1KktNd54FdCNiPhLEA61YQowZ1AQ35W68Y".

well the problem is that this transaction was since 19/05/2017. Near 4 days ago.. and still dont have 1 confirmation... i contact him various time to chargeback my money. and he said that Only if btc get reversed itself he can sent again..

I checked the transaction that he made me on blockchain and it is double spend.. i think that i dont gonna get my payment never..

Is fair to me get scammed by a person that i went first and he got payed. Then he sent to me a fake transaction..

I think that he as a buyer should be responsible for your payment to be made correctly to the seller.

who should lose the money?.

There have been more people that needed to wait a long time before they finally got their confirmations. It might just be that he double spent to get the money back in hopes of sending you the money again but this time faster. Make sure he pays the same amount of bitcoins though (not the same amount of $) as the bitcoin price has risen quite a bit lately.

You can always make a scam report to make sure things are going alright.
