    Reporting Racks on Racks

    Racks on Racks should at the very least be issued a TwC. There is absolutely no reason that action should not be taken against this user because he paid up. There was CLEAR intent to deviate from paying Top Elite after he lost. The moderator even said him/herself that he there was proof presenting this. These types of people are ticking time bombs to the community and situations like these are handled way too lightly.

    There are three possibilities:

    1. Top Elite scammed.
    2. Racks attempted to scam.
    3. Racks traded an irrelevant 3rd party due to a failure to confirm.

    I said there was a proof that a debt existed (this arose when Racks lost the bet). This was never in dispute; Racks never tried to dispute this. A TwC could be awarded, however there is no evidence that Racks intended to scam. A slap on the wrist implies that someone has committed an offence, and we are letting them off lightly. For example, you might have well exceeded the speed limit, but only get a slap on the wrist. You do not get a slap on the wrist for driving at the speed limit: you didn't commit an offence. Here, there is no evidence that Racks committed an offence. This is just a case where the burden of proof lay with Racks, and he was unable demonstrate he had paid Top Elite.

    Whether someone is a 'ticking time bomb' is something evidence needs to support. A TwC cannot be supported by an absence of evidence. Given that Racks acknowledged his mistake (in not evidencing his payment) and quickly paid Top Elite, I gave him the benefit of the doubt and decided a TwC was unnecessary. The burden of proof works both ways.
