in australia is it ilegal for a 14 yr old to have sex with a 14 yr old?

I think this has been said before, but for lack of a better word they use rape. By LAW its Statutory rape, even if he or she agrees to the sexual activity. This is often based on a presumption that people under a certain age do not have the capacity to give informed consent.

So legally, it is rape.

 

If she said yes to sex, it's under-age sex, if he said no, or forced her, it's rape.
Though hardley anyone abeys by the under-age-sex law. Usually the consiquences of under age sex is a fine... For rape, it's up to 15 years in jail.

 

If the guidelines are set then it must be followed, yes its trying to simply protect people who are very much older from commiting this crime, but the only reason he was facing charges is because the girls family, or the girl herself reported... therefore the consent can not have been as the boy may claim.

well i dont really see whats the harm, if she allows it, then i dont think it should count as rape. I really dont think this is fair. or at least make a new rule saying that it does

Ok you have sex with an underaged girl and she wants it.(hopefully you are underaged aswell or you could be doing some serious time) Her parents find out, they call the police and press charges.... these cases are because of the parents.

 

ive been in the same type of situation but im under age and my gf got in shit and stuff but not saying she was a sexual predetor or any jail time.

 

I think that's pretty stupid.

If she agreed to it, and wasn't forced, then it was just an act of love, not rape.

It's called rape becuase leagaly under the age of 16, your not "old enough" to make a decision for yourself..... your not.... Intelligent enough.... So law says anyway

I lost my virginity at 14, and I think it had a great effect on my life. I learnt to appreciate women more, act more mature and more about my sexuality. It has had no negative effects on my life. It in no way has or will screw my life later on, and is totally fine.

 

Nope, in my eyes that's not rape, that's just underage sex, but you know how the politics and government works... No logic, your driving home one day then someone runs out in front of you car, you try your best to miss them but still hit them, they have a broken leg, you're in jail for attempted murder... WTF!?
