Trumps campaign manager charged with simple battery

If you haven't heard, Trump's campaign manager Corey Lewandowski was charged with simple battery against a reporter named Michelle Fields even after Corey specifically said he's never touched her and even went as far as saying he's never even met her.

    Well heres the video and news article;

    http://www.palmbeachpost.com/news/n...harged-with-misdemeanor-battery-on-ex-/nqtkY/

What do you guys think? Do you guys think this will impact Trump's campaign? Should he fire him? Btw simple battery in FL is a $1000 fine and community service.

What i find fascinating is how trump supporters were first calling the reporter a liar because Corey stated he never met her, now that the video is out they're calling her a cry baby.... I don't know about you but i don't want to be grabbed by ANYONE.

This was a proven media hoax. Michelle Fields & the idiots who bought her story like Megyn Kelly and Ben Shapiro lost their reputations.

Then when the video came out proving that Michelle Fields & Ben Terris were lying, they went back on Megyn Kelly's show and doctored the audio clip so that the claim of being thrown to the ground was edited out.

It just goes to prove that you can be in a room with literally more cameras trained on you than anywhere else in the world and still be accused of THROWING SOMEONE DOWN in a misogynistic attack. Michelle claims that Corey moving past her, possibly placing his hand on her shoulder in this above video was the WORST EXPERIENCE SHE'S GONE THROUGH BESIDES HER FATHER'S DEATH.

Ben Shapiro among many others demanded that Trump fire his campaign manager. It's disgusting that he would call for someone to lose their career on account of this blatant hoax.

There's video footage of Trump's campaign manager grabbing her towards her shoulder area. The reporter claims bruises surfaced on her arms towards her wrist. https://twitter.com/MichelleFields/status/708005032839548929/photo/1

This whole thing is blown way out of proportion. The room was very very crowded. Brushing past someone in a room like that is acceptable, and certainly not battery. Grabbing someone's arm (to what extent we do not know), has a stronger case for battery, but I fail to see how you are going to prove intent. It's not unreasonable to slightly grab someones arm as you try to shuffle past in a crowded room for example. Furthermore, her credibility is damaged as her accounts contradict what happened. She certainly didn't almost fall over from that encounter for example.

I mean come on now... the case is going to get thrown out. Battery requires specifically, the element of an intent to inflict injury (or similar wording), to be proved beyond a reasonable doubt. There are many quite reasonable doubts in this case.

So.... She lost credibility when her accounts contradict what happened....so what about his story claiming he never touched her and has never even spoken to her? He still has credibility?

    As for your definition of battery, its incorrect in this case. Simple battery and criminal battery are two different things;

To be charged and convicted of simple battery all the prosecutor needs is this:
    1. an unlawful application of force
    2. to the person of another
    3. resulting in either bodily injury or an offensive touching.

The intent you're speaking of is not the intent to inflict damage but just the intent to commit the act, he clearly aimed straight for her which is intent to commit the act.

So you're telling me, if this guy ran up to you and pulled you away with enough force to move you back a few steps, you wouldn't be atleast pissed off?

Like i said before, i don't want ANYONE touching me.

How does that video posted by some random on youtube prove its a media hoax? I'd need a much more reputable source for your claims.

As for her over exaggeration of the events, she clearly over exaggerated it to draw attention. Does that change the fact that he placed his hands on her? I don't think so. I don't even understand how you can say "possibly placing his hand on her shoulder" Did you not see the video? He's not security, he's not the secret service.

You know what debunks the fact that it's a media hoax? The news network she works for is Breitbart, one of the largest defenders of Trump for the last few months. Why would someone who is pro-Trump make it all up?

But anyway, my point is he should fire him and get away from the scandal. Condemn the guy and distance himself and he'll come out looking better. If the guy is convicted (even if it's only a $1000 fine) it'll probably not look good for Trump's campaign IMO.

Did you watch the video? You can clearly see she was not thrown to the ground, and there is no evidence of physical contact. Use your own eyes for your source.

You mean she clearly lied. Did you see her get thrown to the ground in the above video?

Look at the video I linked above, does her testimony & Ben Terris' testimony match the cold hard evidence? Michelle Fields said this was her worst experience besides her father's death.

    Michelle Fields is pro-Cruz...

Fire him for what? Watch the video. There was no throwing to the ground. Why should he be fired for brushing up against someone in a giant fucking crowd?

Like what the fuck bitch, watch where you are going lmao. Put the video on .25 speed

Do you seriously not see his hand wrapped around the womans arm and being pushed back? Are you insane? He didn't "Brush up" against her, he grabbed her by the arm and forcefully moved her.

Let me zoom in for you

Xiero, unfortunately, the video is completely silent which means absolutely NOTHING and going by your own video not once did she say he threw her to the ground. Ben Terris did, she did not.

But who definitely lied is the manager who claimed he never touched or even saw/spoke to her... Right.......... In that 2nd video you clearly see him come from across the room, extend his arm to her, push her back and continue walking.

Are you trying to say he didn't touch her, he did touch her but she should suck it up, there was no simple battery committed or what? And an FYI, i'm not anti Trump or pro Trump, i may be closer to pro trump than anything but i'm anti putting your hands on people.

So she was in fact not forcefully thrown to the ground?

Dude. Did you even read her article? http://www.breitbart.com/big-journalism/2016/03/10/3276486/

Does someone getting in your way and walking past them in a crowd qualify as meeting someone? Get real.

I'm saying look what happened. The entire crowd is moving in the same direction as Trump, obviously, and Michelle Fields starts walking sideways into the moving crowd, directly in front of Corey & in between Corey & Trump. He brushes her off just like you would any other person in a crowd. The video shows Fields touching Corey & Fields touching Trump, I don't know how that is Corey aggressively throwing Fields to the ground.

Her testimony is that she was forcefully thrown to the ground. The video shows she walked sideways into a giant fucking moving crowd:

So it's her own fault for walking with Trump in an attempt to ask a question (doing her job) ? You're telling me to look at the video which you clearly are NOT WATCHING.

He GRABBED her did he not? It's clear as day, my entire point is he grabbed her and that in and of itself is WRONG.

Answer my question, did he grab her? If the answer is Yes, it's simple battery. If you say no, theirs something wrong with your eyes.

After re-reading the police reports, i think theres much more to the video and they only released a very small portion: http://i2.wp.com/www.dangerandplay....03/corey-lewandowski-police-report-page-2.jpg
He mentions seeing portions of a surveillance tape that isnt in the tape that was released publicly. But anyway, the cop sees exactly what i see and proceeds to charge him with simple battery. You can't willy nilly run up to someone and grab them, its illegal.

She didn't say that Corey grabbed her. She said that he aggressively pulled her to the ground. Forcefully threw her to the ground. Ben Terris' testimony that Corey threw her down.

You are asking me: Did he grab her? Yeah, he extended his arms when Michelle Fields ran into him. This is 100% innocent, and the complete opposite of Michelle & Ben's claim that she was forcefully/aggressively THROWN to the ground.

The burden of proof is on her to prove it to the standard of beyond a reasonable doubt. Her credibility is the most relevant, as even if his is shot (which I don't think it is), because if she gets up and testifys on the stand and says he grabbed me and squeezed very very hard, the cross-examination will just point to all the places in which she contradicted herself, and the judge won' take her seriously. She has the burden of proof remember, not him.

I'm not sure for the US whether the mens rea element is an intent to commit the act, or an intent to cause some harm. Let's say it's an intent to commit the act.

The argument: "he clearly aimed straight for her which is intent to commit the act." Remember the circumstances of it being a crowded room, make it very difficult to read intent into this situation. I would say it's almost an involuntary reflex to touch people as one trys to wade through a crowded room. There's also the argument that there's implied consent on everyone's behalf that they expect to be touched a little bit when they enter such a crowded room. As I said, the mens rea argument is just very weak here, and her low credibility really doesn't help her. Now If he said that "he'd never touched or, or even spoken to her", that could still be true and not impact on his credibility, because if brushing past someone in a crowded room is a relatively innocuous event, then it makes sense you wouldn't realize that you've done such a thing. That would be more consistent to him in a defense on the mens rea element, because, quite simply, he would've said he never even thought about 'grabbing her', but was just trying to get past and keep up with Donald Trump.

As I've said, the case is very weak. It will get dropped. There's no doubt he grabbed her, the question is did he have the requisite intent, and that is hard to prove beyond a reasonable doubt given the circumstances.
