    Accounts/Guest Checkout
    Simple/Easy to use website
    Make buyer accept ToS before taking to payment
    --Not sure if I fully understand, but Payment Gateway

    With that said, I don't have a set budget, someone who can show me creative and professional work will not be disappointed with the amount I'm willing to pay.

    Just have in the ToS something like, By purchasing this product you automatically agree to accepting our Terms?

    Most cart frameworks usually have this anyway. Unless OP is looking for a custom one

    Some popular cart software you can look into
    magento
    opencart
    shopify

    easy to setup, they have a default site layout and you can design elements based on that.
