Getting out of a contract

I have a contracted job with somebody, who, long story short, ended up asking for way more than was originally planned. The first couple weeks of the project were spent on revision after revision (including multiples that she approved and then wanted to change again), and then there were multiple scripting aspects added.

The contract states that I receive 50% payment immediately, and 50% upon publication of the website. If I refund the original 50% payment, am I responsible for anything or am I effectively out of the contract?

Also, if I'm not out of the contract, what's the worst that could happen in court? the 50% payment?

Any advice is appreciated. This is in the U.S. by the way.

 

Even with a refund you're still at a liability to publish the website. I wouldn't let it go to court, you may get fucked. Try and finish it out.

 

It depends entirely on the contract and where you live. Your best bet is to just push through and finish the website, even if the client is being difficult. I recently did a project for a very tough client, and I ended up just taking $200 off the price of the $950 project to make them pay me the rest and get it over with. Some clients can be frustrating for no reason, just try to get through with it and don't deal with them ever again.

 

I suppose that will be the best solution then. I will give the client what is written in the contract and that way I can take my money on the back-end as well. I suppose there is a lesson to be learned from this, so it isn't all for naught. Thanks guys! I appreciate the peace of mind more than you know.

That depends on the website. I've completed full gold selling sites (comparable to R2Pleasent and Graves sites) in under 2 days, with breaks, sleeping, etc.

It all depends on how well you know the languages.

I don't know the specific details, however if she is clearly asking for more than what is contracted for definitely take it to a lawyer.

If she is clearly asking for more then what is written down, you'll be able to at the very least get damages (more money) or terminate the contract and get your money too.

This is because effectively she's 'breaching' or breaking the contract, if the term in the contract outlining specifically what you need to do, and she's asking for more, it's not what you contracted for, breaking such rules/terms in the contract can leave you with A. the option to claim damages (money for breaking the term specifying what you need to do) or B. terminate + claim damages.

Don't quote me since I don't know everything, but if you can find a definite 'drifting away' from what is written you're in a good position if you want to go through with it
