Is this REALLY considered Rape?

A 17 year old, has sex with a 15 year old, she is one year under the age of consent. The 17 year old goes to court and faces charges up to 10 years in Prison and being a sexual predator for all his life, is this really fair? I mean she was willing and she is only 1 year under the age, so why call it rape? Just give the kid a fine or something.

It does not depend. Whether she gave a complete written form of consent or didn't give any consent, it is still rape. Trust me, my gf is 18, I'm not, I know.

But you go into the courtroom and show the judge that, he'll laugh and slap the prison sentence on you like it's nothing. It is ILLEGAL to have sex with someone whom is underage, and, for lack of a better word, they call it rape. Simple as that.

If she wanted it then why did it lead to court she must have said something, so something must have happend that she wasent happy with...

 

Oh on the contrary, I personally know of a girl who wrote about it in her diary. Mom = found diary. Mom = PISSED. Mom = calls cops on boy. Hello rape charges.

 

I think it's not fair, that the boy is being put to jail, cause the girl fully agreed wth having sex with Him.
But the law is the law, there's nothing You can do about it.

 

The sentence is a little harsh, but yes, it is legally considered rape.

Well if the girl is the older one and the boy is the younger one it works just the same. Case and point that teacher that got arrested for rape after having sex with one of her students.

 

It CAN be considered rape, but the thing is...
He can't go to jail for being a "Sexual Predator". You must be 18 years of age or older to have sex with a minor then be considored a "Sexual Predator"

 

Well, if you still have sex with some underage person the law will still punish you heavily.

Well think of it like this, how did he get charged in the first place? Someone must have snitched ( maybe the girl ), or he did the act in public. Maybe the girl had sex with him because she didn't like him, so she did it to get back at him. ( Girls do some crazy things sometimes. ) So she had sex with him, told the police that he raped her, and BAM, he's locked up.

 

I think that is total bullshit. If she fully consented, then there's no (well there shouldn't be) problem.

I think it's racists based. The jury did not know he would go to jail for 10 years... When they found out they were surprised. Anyway this case is pending in Supreme Curt
