    Design rights?

    Important question to ask,

    If I pay someone to design and create something for me, with the purpose of making money, do I have full rights to these designs? (I.e. I'd be able to take 100% profit and be able to sell them in the future.)

    If not, is there a way I can guarantee that the rights are entirely mine?

    That would be like me asking if i bought a welding machine, am i allowed to use it to build stuff to make money.


    Once you pay for it, it is yours to do as you wish.

    Not true really. Most designs don't come with re-sell rights unless you specifically ask.

    Take a look at ThemeForest and you'll see you have to pay like 50x the normal price to get rights to be able to re-sell and make profit from it.

    You can edit the theme for your own needs, but can't re-sell unless the designer states that you have full rights and have permission to re-sell to make a profit.

    Take a look at this example. It's $40 for rights to use for one site and not sell. It's $2,000 if you use it in a product that you re-sell, and that's only for ONE project. Full design rights can be extremely expensive.

    Well by designs I was assuming he meant website design. Maybe he meant a product, in which case it still depends but more than likely you can re-sell.

    I was referring partially to web design, as well as other things. Is it possible to get a Guarantee from the designer/creator which would enable me to re-sell? What form would the guarantee need to be in to be legally acceptable?

    Yes. Any sort of written communication works - an email saying "it's ok for you to re-sell this" works. But to be safe, some sort of contract would be better. 99% of the time this won't be necessary though.

    Bear in mind that resale rights are going to be considerably more expensive than a simple website design.

    Yes, for example, when record companies get the rights to an artist's music.

    You would just have to make sure that whatever is being designed and paid for includes the exclusive rights to resell it.

    If they know what they are doing, they will ask if it's for personal use, or for commercial use [Resell]
