Apple vs. Samsung

To preface my post, I do not know a lot about the case, but I am really interested in learning more and your opinions.

I remember reading somewhere that if Apple wins, they could potentially receive over 2.5 Billion USD in restitution.

I also read that Apple's profit margins on the iPad are roughly $200.

$2,500m USD/$200 profit per iPad = ~12.5m iPad sales profits.

Around 18m iPad were sold last quarter, so the potential gain from the Apple vs. Samsung lawsuit could potentially equate to a 70% rise in iPad sales (figuratively).

This would make the stock price of apple skyrocket too, right?

 

Apple and Samsung sue eachother regularly. They both win lawsuits though, so it's pretty irrelevant.

 

I have not heard about the latest Apple v. Samsung court case, could you link the article?

Seems to be the same old same old. Apple claiming that Samsung are stealing iPhone/iPad designs. The amount of cases I've seen on this is crazy, they should just leave each other alone.

 

I'm generally a fan of Apple products and am sending this post on my Mac, but I think Apple's copyright claims are an abomination of capitalism, over-patenting , reducing creative flow of products and prevents even further mass production of certain technology.. It's just frustrating how they try to patent EVERYTHING.

Now granted, there is obviously some copying going on, that's what happens when you make a major advancement in a market, you gain imitation. But part of advancement is re-working old ideas and by trying so hard to stomp out imitation, I feel that they also stomp out innovation. :noworry:

 

Apple is trying to monopolize everything. The judges are most likely going to rule in favor of samsung.

 

The judge doesn't determine who wins, the jury does. When you look at the documents and arguments Apple has supporting their side, they sound extremely convincing. Also, if you look at the pictures comparing the packaging/box containing samsung vs. apple phones or tablets, it is apparent Samsung copied their design from Apple. The devices themselves are also way too similar in size and layout. Not to mention, the appearance of the operating system and icons of applications are way too similar.

 

But similar doesn't always constitute a breach of IP. They're trends that design always follows and every maker will try their best to match that trend. Apple is overly happy about patenting anything and everything they can so they can sue whoever tries to make money in the handheld market.

 

Companies sue each other all the time, its like a normal thing to them as they try gain the advantage in the market by having unique designs. I think Samsung will win to be honest as Apple are just trying to get ahead of the game but as a few people have said Apple and Samsung always sue each other and so do many other companies.

 

I enjoy Apples products too, but yeah i definitely agree they go overboard. I mean look at iOS 5, they practically stole notification centre from Android. I don't see Google suing them. It's ridiculous.

There's a difference between indefinatley stealing and practically stealing, apple didn't steal and use patents, Samsung did.

As for your claim of apple using androids messaging system, this is a joke, theres complete differences.

Apple sues a company if they even think about making a phone in a color that they use. They stifle the market by patenting stuff that doesn't even deserve a patent and that is why our intellectual property system needs reformed - so that companies have more freedom to create competition in the market without having to worry about getting slapped by a lawsuit. Though as everyone mentioned companies sue each other constantly trying to get one up on each other.

 

Tl;dr.

if by any rare chance you ever had an idea worth patenting I'm sure you would, they protect their ideas to be the best distributed of smart items, they're not stealing ideas contracted by law that says they can't use.

 

Samsung had touch phones that looked like the iPhone before the iPhone can out. You can't patent a rectangle with rounded edges but Apple thinks it can.

 

Actually they do steal ideas. Apple the company patents ideas that the individuals that work for them come up with. I don't see some researcher in a lab somewhere making millions off being able to touch a touchscreen with two fingers.

 

off topic, this is about apple deliberately STEALING and using ideas of apple using patents (legal and approved). if apple was granted a patent for the shape of the phone, Samsung would be violating that patent and be forced to pay the fines, however that's not the claim.

that's a pretty big accusation, I wasn't aware you were an apple developer.

 

So you're saying that Apple, a corporate entity, just generates ideas like some sort of idea algorithm?

The ideas come from individuals that are then stripped from them and patented for Apple's profit and not the individuals. Do you honestly believe Steve Jobs would let someone working for him come up with an original idea and profit off it? Hell no. This argument is useless though, as you're a fanboy and will refuse to see it any other way but as to glorify Apple.

This arguement is useless because of your lack of evidence and false accusations, not my behalf.

 

So you're saying that Apple are fairly compensating employees for original ideas that they're making billions off of? Oh yeah. I am sure they get paid for every iPad, iPod, iPhone sold with the intellectual property they thought up. If you believe that then I have some land in Florida I would like to sell you.

And affording Apple has nothing to do with it, that is a ridiculous accusation you are making. You aren't going to see any other view point than one that will glorify Apple even after it has been clearly argued throughout this thread that they're a overly litigious and patent-crazed company. They're afraid of competition and therefore attempt to eliminate all competition through litigious means. I can assure you that I am not the only one to make this accusation.
