Is botting illegal?

Would jagex be able to prosecute a individual for botting? They have prosecuted illegal botting sites is it in there rights to do so for the consumers of the botting companys?

 

Imagine if Jagex went after every user that botted. Would be alot of money wasted for no gain/profit.

Easier to go after the websites that destribute the clients and the people that script them and profit on there sales.

As a user you are safe for any legal actions.

The Snellman Bros got sued to copy-write infringement for using RS image and deobfuscating the client.

In no way can you get in any legal trouble for USING a bot....

 

also snellman made profit, thus jagex can bs up a reason for "damage"

It's not illegal, as there is now law against using an automated program to play a game for you. There's no legal consequences as an individual botter, the only people at risk are bot developers which breach Jagex's copyright by using their own code/manipulating it.

 

I think in some countries the bot companies are vunarable to laws/fines however they usually get somthing to prevent JaGeX from filing a law suite against them.

 

Didn't jagex send an inbox message to individual botting customers threatening legal action if they used them again? Did anything come out of that?

 

I can remember this happening before, I think it was probably more than anything just scare tactics.

Although at the end of the day, I guess when you create an account you agree to Jagex's terms and conditions which underline that you cannot use third party software which is against this 'contract' and therefore would probably have a chance of brining civil action against a person for breach of contract.

 

I'm quite sure this pertains to iBot & NeXus users.

A ToS isn't a legally binding document though. It is just to let you know your rights as a consumer and their rights as the supplier. There is no legality in a ToS.

 

They have made threats in the past. However, I highly doubt anything will happen.

 

No unfortunately you aren't correct, while most of the time ToS are used in order to restrict access and remove a persons use of service, it is a contract. For example when Sony corporation took George Hotz to court for breach of contract following the violation of their ToS.

TOS is loosely used in minor cases, but in big cases where damage has been done, the TOS is considered but not does not have a significant effect on the verdict.

 

That's what I'm saying, so therefore the ToS does, to some degree, have legal significance.

 

It is not illegal to use the bots, however it IS illegal to design any client that loads the RS.jar to RAM. By creating a client that loads RS, without the permission of Jagex themselves, you are legally breaking the Digital Millenium Copyright Act.

Some might say, 'Oh what about Swiftkit?' Well, when Swiftkit first came out, there were bans from players using it, and Jagex actually threatened Swiftkit with legal action, causing them to meet and Swiftkit to sign contracts and agreements with Jagex, allowing them to continue with the development of said client. Jagex obviously isn't going approve a Bot Client.

 

It's against their ToS, so they have every right to ban botters from playing their game.
They don't, however, have the right to take any legal action whatsoever.

 

yes, but chance of some one getting sued for a large amount for only breaking tos is very VERY unlikely.
