Official Judgement on Paste in Effects in the GFX Section

As some of you may recall, Chinesekid recieved a GFX section forumban for buying the standard license of This and selling the resulting works.
However, the situation seemed rather unofficial and no real rules have been made on "Paste-in Effects" such as:

What is the official judgement on the commercial use of these effects as far as ripping or stealing is concerned?

 

if you're not legally allowed to use it and sell it, then its plagiarism.

 

But the same rules applies for fonts. Fonts are free for personal use and not necessarily free for monetary reasons. That is basically the same. Do all the artists on sythe need to buy full-rights of a font too?

 

And buy all the rights to use Jagex's intellectual property? (IE: the Wikia images. )

 

As someone with a graphics & media based background, I believe that it's important for us to let people flourish. If that means they're using material that they don't necessarily own rights to, then so be it. I do not condone 'ripping'* other peoples' work, however, and believe that should still be punished. Using those light effects is essentially the same as using C4Ds, Renders and brushes.

*Directly stealing other peoples' work and claiming it to be ones own.

The ban on that guy mentioned in OP was for different reasons rather than just Using those effects he didnt own.

 

Then you must agree that ChineseKid's original ban was unjust? Which is what I have said all along. That ban was a move to eliminate competition in the GFX section and was completely off base. I didn't like the kid's attitude but what this community did to him was very, very wrong. I mean I would hate to think that if I was poised to become major competition that I could possibly get banned on 'trumped up' charges.

Though back on topic, I agree with Verts on this issue and always have but I believe that if the rule is used on one person then it should be used on them all. Which is not what happened in this situation.

Not completely true, he was originally banned for ripping and then was allowed to come back but was forumbanned from the GFX section which was the only reason he was here. The resulting ban would have never happened if the forumban was a just one.

 

Yes, but it was a major factor in it. He did recieve a GFX section Forumban though, which is what I was discussing.
For those of you who are unaware, after the forum ban, he asked a self-req ban and then impostored Kina on smokingmills.com

He was indeedy banned for imposting me back then, not to forget about him talking crap towards me for TONS of times.. however: this is about the suggestion, not about that 13 yr old.

We've talked about it 2-3 months ago and came to the conclusion that it is OK to use ELEMENTS that aren't yours, as long as they DO NOT define your work.
You may also not claim that these are yours if asked so..
The "elements" that you may use should be minor details to your work and as I said, not define the whole piece.

If there are any questions regarding this, I'd gladly help out.

On another note: just make the damn things yourself.. that's how you gain experience after all!

 

Sorry, I only just noticed this thread. I would have to agree with verts here, if we don't give people any freedom then the section will just die out entirely. This is a cheating/blackmarket forum after all, it would be silly to ban people for selling graphics works containing things they don't own. However, as Kin pointed out, if you rip someone's work and it becomes the major part of your own work then that's not acceptable.

Ok Good to see some real judgement. This was mostly from me noticing these effects in MrLuckyDraw's works and wondering after discussing it with him agreeing to make a thread to get a decision once and for all.

 

Nice to see this kind of sorted out. Maybe its fitting to include this in the "do not rip" sticky on the graphics section for future reference and for other newcommers to read.

 

if your going to ban users for using a type of font/effect with a standard license, well then shouldn't you also ban users who use a pirated GFX tool?

if your going to go that far, mind aswell go all the way.

i would think they could be allowed to use it aslong as its not a complete copy and paste, if you state if you can't legally sell it, well what if the program its made on isn't legally owned aswell?
