Can an administrator do a final, clear ruling on personal information?

I always seem to get the shittier end of the stick when it comes to this rule, so maybe I'm just not understanding it correctly.

As the rule(s) currently states:

Disclosure of Others' Personal Information: posting information such as private emails / MSNs, private Skype accounts, Facebook accounts, addresses, phone numbers, private photos, etc. of someone other than yourself without explicit consent of that person will result in up to a 1 month ban regardless of whether or not the information is publicly available.

Defacing user photographs: Defacing someone else's picture (drawing on it, photoshopping etc.) without that user's full consent will receive a 1 week ban.

Now, this finally has made it clear that:

Private information, even contact information such as Skype are included
Even if it's publically available, it doesn't matter

Now I'm going to list some situations with the outcome:

Someone posted my full name/picture on Spam forum.
Result: The post was removed. No punishment.

I posted a link to R2Pleasent's mom's WHOIS information. It included his name.
Result: Banned for one month.

Someone used a photo of my sister as their Skype photo.
Result: Nothing was done.

Someone posted a member's photo, with consent. The member said it wasn't permitted as a joke.
Result: Person was banned for a month.

A banned member's information was posted in the spam forum.
Result: It was fairly encouraged.

My questions:
Are banned members protected under this rule?
Are member's immediate family members included as well?
Is it also covered anywhere outside of Sythe?

Which would lead me to believe that banned members are protected. I did proceed to post some information nonetheless =p. No one cared about the info I posted (infraction-wise).

I posted a Jmod pastebin (had her dox in it oopsies), which was only deleted promptly, then I reposted with her name still showing and I received only an infraction, luckily <3. (I just wanted to spread the word =[).

So, my conclusion as a normie member is that it is one of those "use your judgement" issues... doing something about someone's Skype pic is silly, for instance, but I don't think it'd be appreciated if I started posting doxes of Sythe members on BA or powerbot ya know.

No one month ban for me, please <3.

The rule is very specific but doesn't hold enough ground. It really depends on who posts it and who it is about. Wouldn't be surprised if I was told otherwise. I would continue to hassle a staff member to take action in your position if you really want to see something being done.

There's an unwritten element of intent in the rule;

If the disclosure is a joke (in poor taste) we normally just remove it and keep an eye on the user who posted it. It is still against the rules but we don't like banning people unless some actual harm is done.

If, on the other hand, it is done in malice OR the victim files a scam report and requests the full punishment be applied then the one month ban is used.

The rule applies to any person's information. However, the staff may publish personal information where we feel it is both legal and necessary (i.e. to warn people of or shame a verified scammer.)

I'm glad this rule is here. I really didn't know about it until now.

But, I don't think that banned members should be protected. If they scam someone, it should be published information on them so we can all see who they are.

Then you get into privacy laws, and Sythe as a business organization can get into trouble with that stuff - both criminally and civilly. That is why Richard mentioned that staff can only post what they're legally allowed. You can't just go around and share anyone's personal information you want to.

Oh, I see. Shouldnt there be a way if they steal from you or someone though and you have proof? Like they put information about people on TV shows? Like Americas Most Wanted.

Sythe isn't a policing organization or have authority to police anything outside of Sythe and Richard's private property.

There is a simple matter of public record when someone is a verified criminal. This goes way back to early common law when WANTED posters would be hung in the street and published in the local circulars. However members are not authorized to decide what constitutes a scam and whether or not a particular person is the responsible party. If for example you get it wrong and violate some innocent third party's right to privacy there can be significant legal consequences.

Hence only staff may post personal information and only when legal to do so.
